【摘要】：冷戰(zhàn)后,日本海外派兵的法制化進(jìn)程始終受到"禁止行使集體自衛(wèi)權(quán)"原則的束縛。對(duì)此,在自民、公明兩黨組成的"自公聯(lián)盟"框架下,安倍內(nèi)閣促使國會(huì)通過了旨在實(shí)現(xiàn)海外派兵的集體自衛(wèi)權(quán)立法。根據(jù)新安保相關(guān)法案的規(guī)定,日本可以隨時(shí)向海外派兵并向其他國家軍隊(duì)提供支援,其要旨大多涉及行使集體自衛(wèi)權(quán)、擴(kuò)大自衛(wèi)隊(duì)海外軍事行動(dòng)范圍等內(nèi)容。這一集體自衛(wèi)權(quán)立法,打破了日本海外派兵的自我限制、違背了立憲精神、滿足了同盟需求、加劇了地區(qū)不安。
[Abstract]:After the Cold War, the legalization of Japanese troops abroad was bound by the principle of "prohibiting the exercise of the right of collective self-defense." In this regard, under the framework of the "self-governing coalition" formed by the two parties, Abe's cabinet urged Congress to pass legislation on collective self-defence aimed at implementing the sending of troops abroad. According to the provisions of the new security-related law, Japan can send troops overseas at any time and provide support to the armed forces of other countries, the main thrust of which mostly involves the exercise of the right of collective self-defence and the expansion of the scope of overseas military operations of the self-defense forces. This collective right of self-defense legislation broke the self-restriction of sending troops overseas, violated the spirit of constitutionalism, satisfied the needs of the alliance, and aggravated the regional uneasiness.
