【摘要】：氣候變化問題日益受到人們的關(guān)注。從召開國(guó)際會(huì)議討論氣候問題,再到形成具有法律效力的國(guó)際氣候合作制度,全球氣候合作取得了重大進(jìn)展,也經(jīng)歷了重重困難。但是對(duì)于國(guó)際氣候合作制度是否有效,有效程度是多少,在什么方面有效的問題并不能就此下定論。因此,通過構(gòu)建國(guó)際制度有效性標(biāo)準(zhǔn)的衡量框架,對(duì)國(guó)際氣候合作制度的有效性進(jìn)行檢驗(yàn),可分析出現(xiàn)存的聯(lián)合國(guó)框架下的國(guó)際氣候合作制度的效用、效用程度及其影響因素,為后京都時(shí)代的國(guó)際氣候合作制度有效性提升提供某種程度上的指導(dǎo)方向。其中,本文通過對(duì)國(guó)際制度有效性概念作可操作化分析,構(gòu)建出國(guó)際制度有效性標(biāo)準(zhǔn)的分析框架,即通過對(duì)國(guó)際制度合法性、效率和公平性的分析,衡量國(guó)際制度有效性的程度。 通過分析研究,得出了以下結(jié)論:首先,國(guó)際氣候合作制度是解決氣候問題的必由之路。其次,國(guó)際氣候合作制度的合法性、公平性較高,而效率較低,因此國(guó)際氣候合作制度的有效性較低。再次,影響國(guó)際氣候合作制度有效性的因素包括具體和深層因素兩方面。最后,國(guó)際氣候合作制度的未來走向并不確定,后京都時(shí)代國(guó)際氣候合作制度的有效性問題主要表現(xiàn)為國(guó)際氣候合作制度的延續(xù)和改進(jìn)。
[Abstract]:The problem of climate change is getting more and more attention. From convening an international conference to discussing climate issues to forming an international climate cooperation system with legal effect, global climate cooperation has made great progress and experienced many difficulties. But the question of whether and to what extent the international climate cooperation system is effective cannot be decided. Therefore, by constructing a framework to measure the effectiveness of the international climate cooperation system and testing the effectiveness of the international climate cooperation system, the effectiveness, the degree of effectiveness and the influencing factors of the existing international climate cooperation system under the framework of the United Nations can be analysed. It provides some guidance for the improvement of the effectiveness of the international climate cooperation system in the post-Kyoto era. Among them, through the operational analysis of the concept of international institutional effectiveness, this paper constructs an analytical framework of international institutional effectiveness standards, that is, through the analysis of the legitimacy, efficiency and fairness of international institutions. Measure the effectiveness of the international system. The conclusions are as follows: firstly, international climate cooperation system is the only way to solve climate problems. Secondly, the legitimacy, fairness and efficiency of the international climate cooperation system are relatively high, so the effectiveness of the international climate cooperation system is low. Thirdly, the factors that affect the effectiveness of international climate cooperation system include specific and deep factors. Finally, the future direction of the international climate cooperation system is uncertain. The effectiveness of the international climate cooperation system in the post-Kyoto era is mainly reflected in the continuation and improvement of the international climate cooperation system.
