【摘要】："棱鏡門"事件揭示了不受規(guī)制的情報監(jiān)控行為對國家主權(quán)、公民基本人權(quán)的極大危害,應(yīng)該對國家情報監(jiān)控行為設(shè)定"邊界"予以規(guī)范。國家情報監(jiān)控行為應(yīng)有合法的權(quán)力來源和正當目的,應(yīng)注意平衡本國國家安全需要與他國國家主權(quán)與公民的基本權(quán)利。規(guī)制國家情報監(jiān)控行為,是在接受該種行為的現(xiàn)實存在及其合理性的前提下,盡量減少該行為的危害。國際社會可以通過借鑒"戰(zhàn)爭正義"理論的相關(guān)標準,探索規(guī)范國家情報監(jiān)控行為的國際規(guī)則,遏制國家情報監(jiān)控行為的濫用。
[Abstract]:The "Prism Gate" incident reveals the great harm to the sovereignty of the state and the basic human rights of citizens caused by the unregulated intelligence surveillance behavior, which should be regulated by setting the "boundary" of the state intelligence monitoring behavior. The state intelligence surveillance should have legal power source and legitimate purpose, and should pay attention to balancing the national security needs of other countries with the national sovereignty and the basic rights of citizens. The regulation of the state intelligence monitoring behavior is to reduce the harm of the behavior on the premise of accepting the existence and rationality of the behavior. The international community can use the relevant standards of the theory of "war justice" for reference to explore the international rules to regulate the behavior of national intelligence surveillance, and to curb the abuse of the behavior of national intelligence surveillance.
