【摘要】： “人道主義干預(yù)”并不是西方世界所特有的現(xiàn)象,但西方人道主義干預(yù)是冷戰(zhàn)結(jié)束后國際關(guān)系領(lǐng)域最重要理論思潮與實(shí)踐,對國際社會(huì)產(chǎn)生了重大影響。本文主要集中研究西方人道主義干預(yù)的發(fā)展歷程,整理和分析西方人道主義干預(yù)的理論形成和演化過程,通過結(jié)合理論對具體案例的分析,認(rèn)為人道主義干預(yù)仍然將成為今后西方進(jìn)行干預(yù)的主要形式和內(nèi)容。西方的人道主義干預(yù)更多的是為了西方國家自身的利益而服務(wù),常常拋開聯(lián)合國單獨(dú)行動(dòng),其行為在國際上是違法的而且得不到廣泛認(rèn)同。 本文還對非西方的人道主義干預(yù)的理論與實(shí)踐做了研究,認(rèn)為非西方的人道主義干預(yù)多數(shù)是在聯(lián)合國框架協(xié)議以內(nèi),主要解決國際爭端、國際救援等問題,防止戰(zhàn)爭的發(fā)生、改善被干預(yù)國人民的生存環(huán)境,并實(shí)現(xiàn)干預(yù)雙方的利益共贏,是得到廣泛認(rèn)可的行為,因而是合理合法的。作為一個(gè)世界大國,中國是聯(lián)合國安理會(huì)常任理事國之一,承擔(dān)著艱巨而又重要的國際責(zé)任,對于國際和地區(qū)的爭端、災(zāi)難等問題不能置之不理,此時(shí)中國可以通過聯(lián)合國框架協(xié)議內(nèi)規(guī)范的人道主義干預(yù)形式對爭端和災(zāi)難地區(qū)進(jìn)行干預(yù),從而更有效的承擔(dān)國際義務(wù),為世界的和平與穩(wěn)定做出自己應(yīng)有的貢獻(xiàn)。
[Abstract]:"Humanitarian intervention" is not a unique phenomenon in the western world, but it is the most important theoretical trend and practice in the field of international relations after the end of the Cold War, which has exerted a great influence on the international community. This paper focuses on the development of western humanitarian intervention, collates and analyzes the formation and evolution of the western humanitarian intervention theory, and analyzes the specific cases by combining the theory. It is believed that humanitarian intervention will still be the main form and content of western intervention in the future. Western humanitarian intervention is more in the service of the West's own interests, often without the United Nations acting alone, its actions are illegal internationally and are not widely accepted. This paper also studies the theory and practice of non-western humanitarian intervention. It is believed that the majority of non-Western humanitarian intervention is within the framework agreement of the United Nations, mainly to resolve international disputes, international aid and other issues, to prevent the occurrence of war. It is widely accepted that improving the living environment of the people of the affected country and realizing the mutual benefit of both sides of the intervention is reasonable and legitimate. As a world power, China is one of the permanent members of the UN Security Council, bearing arduous and important international responsibilities. It cannot ignore international and regional disputes, disasters, and other issues. At this time, China can intervene in disputes and disaster areas through the form of humanitarian intervention, which is regulated in the UN Framework Agreement, so that it can more effectively undertake international obligations and make its due contribution to world peace and stability.
