侵華日軍細菌戰(zhàn)中國受害者訴訟研究

【摘要】： 在當今中日關系問題上,歷史遺留問題一直困擾著中日兩國政府和人民。日本長期侵華戰(zhàn)爭,特別是慘無人道的細菌戰(zhàn),它是日本在二戰(zhàn)期間在中國犯下極其嚴重的罪行。由于歷史原因使得侵華日軍細菌戰(zhàn)問題遺留下來。20世紀80年代末的中國民間對日索賠運動興起,侵華日軍細菌戰(zhàn)中國受害者訴訟作為中國民間對日索賠訴訟的重要方面,也開展起來。中國民間細菌戰(zhàn)訴訟經(jīng)歷了一個長期艱難的歷程歷經(jīng)十余年。索賠訴訟是戰(zhàn)爭受害者自覺運用法律武器維護自身合法權利的重要方式,也是受害者采取的正義和必要的行動。對日細菌戰(zhàn)受害訴訟的根本目的就是追究日本軍國主義的戰(zhàn)爭罪責,為受害者討回公道和尊嚴。盡管細菌戰(zhàn)受害訴訟均以失敗告終,但訴訟的積極意義不可低估。 侵華日軍細菌戰(zhàn)問題的最終解決,民間和解、政治途徑解決的可能性凸顯出來。通過中國民間對日索賠訴訟達成的三份和解:花岡和解、大江山和解、西松和解之間比較和它們的積極意義,對細菌戰(zhàn)問題的解決帶來啟示。中日政府間政治解決侵華日軍細菌戰(zhàn)問題也存在可能,中日之間歷史問題的解決對于兩國發(fā)展交流、對于東亞及其世界和平與發(fā)展將會帶來積極作用。
[Abstract]:In today's Sino-Japanese relations, historical issues have plagued the Chinese and Japanese governments and peoples. Japan's long-term invasion of China, especially the inhuman bacteriological warfare, was a very serious crime committed by Japan in China during World War II. As a result of historical reasons, the problem of bacterial warfare of Japanese invaders in China has been left behind. The Chinese folk claim for compensation against Japan rose at the end of the 1980s. As an important aspect of the Chinese folk claim proceedings against Japan, the Chinese victim lawsuit of the Japanese invasion of China is regarded as an important aspect of the litigation against Japan. It is also being carried out. Chinese folk bacteriological warfare litigation has experienced a long and difficult course through more than ten years. Claim lawsuit is an important way for war victims to use legal weapons to defend their legal rights. It is also a just and necessary action taken by victims. The fundamental purpose of the lawsuit against the victims of the Japanese germ war is to hold the Japanese militarists responsible for the war crimes and to seek justice and dignity for the victims. Although the litigation of bacterial war victims ended in failure, but the positive significance of litigation can not be underestimated. The possibility of settling the problem of bacterial warfare of Japanese invading China, folk reconciliation and political solution is highlighted. The comparison between the settlement of Huagang settlement, the settlement of Dajiangshan and the settlement of Xisong and their positive significance bring enlightenment to the settlement of the problem of bacteriological warfare. It is also possible to solve the problem of bacterial warfare between Chinese and Japanese governments. The solution of historical problems between China and Japan will play a positive role in the development of exchanges between the two countries and in the peace and development of East Asia and the world.
