【摘要】：當今，恐怖主義已對各國的國家安全、社會穩(wěn)定和人民生命財產(chǎn)安全構(gòu)成了嚴重的威脅，并影響了國際社會的穩(wěn)定和繁榮。尤其是911事件后，恐怖主義問題成為了包括“世界警察”美國在內(nèi)的世界各國的棘手問題。為了防范和打擊恐怖主義行徑，維護國家安全和社會秩序，許多國家將反恐內(nèi)容列入國家法律，或進行專門反恐立法。但就目前看來，反恐立法存在諸多難點，如在對恐怖主義等相關(guān)概念的界定、如何協(xié)調(diào)保護公民權(quán)利與打擊恐怖活動之間的矛盾，如何更有效的通過國際合作途徑打擊恐怖主義。近年來，隨著“東突”勢力的崛起和發(fā)展，我國也面臨著國內(nèi)外恐怖勢力的干擾和威脅，反恐任務(wù)艱巨。在反恐立法方面，我國應(yīng)充分借鑒國外的成功做法和經(jīng)驗，避免走彎路，，積極探求一條適合我國國情的反恐立法之路。 本文以恐怖主義及國外反恐法的發(fā)展概況為出發(fā)點，探討了恐怖主義產(chǎn)生的根源及特征，分析了國外反恐立法進程中存在的問題與困難，提出了國外反恐法對我國的啟示與借鑒。在綜合以上分析的基礎(chǔ)上提出：我國應(yīng)選擇科學的立法模式，對反恐怖主義中的基本概念和有關(guān)問題進行明確界定，同時充分考慮人權(quán)保障和國際反恐合作問題，制定出臺適合我國中國特色社會主義基本國情的反恐法律。
[Abstract]:Today, terrorism has posed a serious threat to the national security, social stability and the safety of people's lives and property, and has affected the stability and prosperity of the international community. Especially after 9 / 11, terrorism has become a thorny problem in the world, including the police of the world. In order to prevent and combat terrorist acts and maintain national security and social order, many countries have incorporated the content of counter-terrorism into their national laws, or made special anti-terrorism legislation. However, at present, there are many difficulties in anti-terrorism legislation, such as the definition of related concepts such as terrorism, and how to reconcile the contradiction between the protection of civil rights and the fight against terrorist activities. How to fight terrorism more effectively through international cooperation. In recent years, with the rise and development of East Turkistan forces, China is also facing the interference and threat of terrorist forces at home and abroad. In the aspect of anti-terrorism legislation, our country should draw lessons from the successful practices and experiences of foreign countries, avoid detours, and actively explore a way of anti-terrorism legislation suitable for our national conditions. Based on the general situation of terrorism and the development of foreign anti-terrorism laws, this paper discusses the origin and characteristics of terrorism, and analyzes the problems and difficulties existing in the process of foreign anti-terrorism legislation. The enlightenment and reference of foreign anti-terrorism law to our country are put forward. On the basis of the above analysis, it is proposed that our country should choose a scientific legislative model and clearly define the basic concepts and related issues in the fight against terrorism, while fully considering the issue of human rights guarantees and international cooperation against terrorism, Formulate and promulgate anti-terrorism laws suitable for the basic national conditions of socialism with Chinese characteristics.
