【摘要】：冷戰(zhàn)結(jié)束之后,聯(lián)合國集體安全機制的困境越來越突出。在安理會的決策方面,大國一致原則導(dǎo)致的選擇性制裁和反應(yīng)遲鈍問題日益凸顯。在軍事行動的執(zhí)行方面,安理會缺乏及時和有效的管控手段。與此同時,戰(zhàn)略轉(zhuǎn)型后的北約以"危機應(yīng)對"為路徑,開始謀求成為全球性集體安全機制。在"自愿合作"取代"整體對外",成為軍事干涉的決策基礎(chǔ)之后,北約的軍事干涉機制更加高效,但也更加危險�？扑魑謶�(zhàn)爭與利比亞戰(zhàn)爭都說明:聯(lián)合國與北約兩種集體安全機制的兼容存在相當(dāng)大的困難,但并非不可能。實現(xiàn)兼容的兩個前提是北約的軍事干涉能夠獲得安理會的事先授權(quán),并且安理會能夠?qū)Ρ奔s的軍事行動實施及時和有效的管控。當(dāng)兩者無法兼容時,考慮到北約集體安全機制的封閉性、進(jìn)攻性和危險性,我們只有堅持安理會的權(quán)威才能真正保障世界和平。國際社會不應(yīng)對聯(lián)合國集體安全機制失去信心。一方面,即使美國及其北約盟國也無法徹底放棄聯(lián)合國集體安全機制;另一方面,在推動聯(lián)合國改革的基礎(chǔ)上,通過遵守和完善《聯(lián)合國憲章》所規(guī)定的集體自衛(wèi)權(quán)與區(qū)域辦法,兩種集體安全機制仍然可以實現(xiàn)兼容。
[Abstract]:After the end of the cold war, the plight of the United Nations collective security mechanism has become more and more prominent. In terms of Security Council decision-making, selective sanctions and slowness of response due to the principle of consensus among big powers have become increasingly prominent. The Security Council lacks timely and effective means of control over the implementation of military operations. At the same time, after the strategic transformation, NATO began to seek to become a global collective security mechanism with crisis response as its path. After "voluntary cooperation" replaced "overall external" as the basis for military intervention, NATO's military intervention mechanism is more efficient, but also more dangerous. Both the war in Kosovo and the war in Libya show that the compatibility of the two collective security mechanisms between the United Nations and NATO is difficult, but not impossible. The two prerequisites for compatibility are that NATO's military intervention can be authorized by the Security Council in advance and that the Security Council can exercise timely and effective control over NATO's military operations. When the two cannot be compatible, given the closed, offensive and dangerous nature of NATO's collective security mechanism, we can truly safeguard world peace only by upholding the authority of the Security Council. The international community should not lose confidence in the collective security mechanism of the United Nations. On the one hand, even the United States and its NATO allies cannot completely abandon the collective security mechanism of the United Nations; on the other hand, on the basis of promoting the reform of the United Nations, By adhering to and perfecting the right to collective self-defence as stipulated in the Charter of the United Nations and regional approaches, the two collective security mechanisms can still be compatible.
