【摘要】：索馬里海盜問題在冷戰(zhàn)結(jié)束后逐漸上升為全球最為嚴(yán)重的非傳統(tǒng)安全問題之一,給全球最主要貿(mào)易國的海上通道安全造成了巨大威脅。從公共產(chǎn)品視角來看,國際社會(huì)對(duì)索馬里海盜的治理,實(shí)質(zhì)上是一個(gè)各參與方聯(lián)合供給國際公共產(chǎn)品的過程。各參與方盡管大都屬于域外方,但不論是從法律還是理論層面,都有充分的依據(jù)參與索馬里海盜治理、提供國際公共產(chǎn)品。從現(xiàn)實(shí)來看,在聯(lián)合國安理會(huì)等國際組織的主導(dǎo)下,2008年至今世界各國在索馬里附近海域進(jìn)行了大規(guī)模護(hù)航,并對(duì)索馬里海盜陸上基地開展了有力打擊,遏制了索馬里海盜的蔓延。今后,包括中國在內(nèi)的國際社會(huì)仍應(yīng)堅(jiān)持在聯(lián)合國安理會(huì)框架下行動(dòng),捍衛(wèi)國際社會(huì)參與治理索馬里海盜的國際法基礎(chǔ);建立一個(gè)能保證各國長期合作,共同提供公共產(chǎn)品的國際機(jī)制;豐富公共產(chǎn)品的供給類型,更多地著眼于提供關(guān)于索馬里海盜治理的"下游公共產(chǎn)品",對(duì)海盜的司法管轄及其產(chǎn)生根源等問題給予重點(diǎn)關(guān)注,將公共產(chǎn)品供給與索馬里國內(nèi)治理聯(lián)系在一起,以期實(shí)現(xiàn)索馬里及周邊國家的長治久安。
[Abstract]:After the end of the Cold War, the problem of Somali piracy has gradually become one of the most serious non-traditional security problems in the world, which poses a great threat to the security of the main trading countries in the world. From the perspective of public goods, the governance of Somali pirates by the international community is essentially a process in which all participants jointly supply international public goods. Although most of the participants are outside the territory, there are sufficient grounds for participating in Somali piracy governance and providing international public goods, both from the legal and theoretical aspects. In reality, under the leadership of the United Nations Security Council and other international organizations, countries around the world have carried out large-scale escorts in the waters off Somalia since 2008, and have been able to combat Somali pirate land bases. Curbed the spread of Somali pirates. In the future, the international community, including China, should continue to act within the framework of the United Nations Security Council to safeguard the basis of international law for the participation of the international community in the governance of Somali pirates; and to establish a guarantee of long-term cooperation among all countries. International mechanisms for jointly providing public goods; enriching the types of supply of public goods, focusing more on the provision of "downstream public goods" on the governance of Somali pirates, and focusing on issues such as the jurisdiction of pirates and their root causes, The supply of public goods is linked to the internal governance of Somalia in order to achieve long-term stability in Somalia and its surrounding countries.
