【摘要】：中日《馬關(guān)條約》在中國(guó)近現(xiàn)代史中舉足輕重,它的簽署標(biāo)志著中國(guó)真正步入一個(gè)以西方國(guó)際公法為規(guī)則體系構(gòu)建出來(lái)的國(guó)際秩序�！恶R關(guān)條約》迫使傳統(tǒng)中國(guó)體制從根本上遭遇到一個(gè)新的世界法權(quán)體系的前所未有的挑戰(zhàn),且全方位地顛覆了原先的宗藩朝貢體制,促使其不得不改弦更張,進(jìn)行法制與禮儀制度的變革。從形式理性、實(shí)體架構(gòu)和法理根基三個(gè)國(guó)際公法的層面審視《馬關(guān)條約》,我們看到,《馬關(guān)條約》固然對(duì)中國(guó)創(chuàng)巨痛深,但也具有正面的憲制意義。它蘊(yùn)含著破除與塑造的雙重法意,揭示了中國(guó)之古今之變的現(xiàn)代轉(zhuǎn)型過(guò)程,是在一種伴隨外來(lái)強(qiáng)制力的國(guó)際公法之中外約章的規(guī)范下的內(nèi)部體制之變革過(guò)程,因此也是一個(gè)由外到內(nèi)進(jìn)而再由內(nèi)到外的變法改制過(guò)程。此外,《馬關(guān)條約》還觸及國(guó)際秩序中的文明正義論問(wèn)題,中日兩國(guó)關(guān)于這場(chǎng)戰(zhàn)爭(zhēng)的申辯理由關(guān)涉著兩種文明價(jià)值觀及其相互之間的對(duì)峙。從文明演進(jìn)論的視角來(lái)看,它們又與古今中西交匯之際的中日兩國(guó)之歷史處境有著實(shí)質(zhì)性的關(guān)系,傳統(tǒng)的中華文明經(jīng)歷這場(chǎng)巨大的沖擊,無(wú)疑將面臨著文明重鑄的新命。
[Abstract]:The Treaty between China and Japan played an important role in the modern history of China. Its signing marks China's real entry into an international order based on the rule system of Western public international law. The Treaty of the people's Republic of Macedonia forces the traditional Chinese system to encounter an unprecedented challenge to a new world legal system. And it overturned the original tributary system and forced it to change course and reform the legal system and etiquette system. From three aspects of public international law, namely formal rationality, substantive structure and legal basis, we can see that the Treaty has great pain for China, but it also has positive constitutional significance. It contains the double legal meaning of breaking and shaping, and reveals the modern transition process of China's ancient and modern changes, which is a reform process of the internal system under the norms of a kind of international public law, which is accompanied by a kind of external coercive force. Therefore, it is also a process of reform from outside to inside and then from inside to outside. In addition, the Treaty of Malaysia also touches on the issue of civilized justice in the international order. The justification of the war between China and Japan is related to the two civilized values and their confrontation with each other. From the point of view of the theory of civilization evolution, they also have a substantial relationship with the historical situation of China and Japan when the ancient and modern China and the West meet each other. The traditional Chinese civilization will undoubtedly face the new destiny of civilization re-casting after this great impact.
