【摘要】：國際難民問題由來已久,歐洲難民危機(jī)的發(fā)生暴露了難民問題的嚴(yán)重性。對"難民"的界定相對滯后,現(xiàn)行國際立法不足以調(diào)整新型難民、難民與原住國內(nèi)因的"標(biāo)與本困境"、目的國的移民融入構(gòu)成當(dāng)前國際難民問題的主要挑戰(zhàn)。根源因素、地緣因素、法律與政策因素、后果因素分別制約著國際難民問題的應(yīng)對措施。在國際層面,以人權(quán)、人道主義保障作為宗旨和原則,制定具有普遍效力的法律規(guī)則與國際標(biāo)準(zhǔn),采用整體治理方法,擴(kuò)大不同層次的合作,從根源上管理和保護(hù)國際難民。中國的積極參與,優(yōu)化國內(nèi)法律政策,強(qiáng)化與國際移民組織的合作,將為國際難民有效治理提供中國經(jīng)驗。
[Abstract]:The international refugee problem has a long history, the European refugee crisis exposed the seriousness of the refugee problem.The definition of "refugee" is relatively lagged, the current international legislation is not enough to adjust the new type of refugees, the "standard and this dilemma" of the refugees and their home countries, and the integration of migrants in the destination country constitute the main challenge of the current international refugee problem.Root factors, geographical factors, legal and policy factors, and consequence factors respectively restrict the response to international refugee problems.At the international level, with human rights and humanitarian security as its purpose and principle, it is necessary to formulate universal legal rules and international standards, adopt a holistic approach to governance, expand cooperation at different levels, and manage and protect international refugees at the root causes.China's active participation, the optimization of domestic legal policies and the strengthening of cooperation with the International Organization for Migration will provide China's experience for the effective governance of international refugees.
