【摘要】：目前,在國際范圍內(nèi),恐怖主義犯罪事件頻繁發(fā)生,嚴(yán)重地危害著世界和平與發(fā)展。恐怖主義犯罪往往會誘發(fā)一些地區(qū)性局部戰(zhàn)爭、挑起武裝派別的沖突、制造大規(guī)模的傷亡慘案,是不斷蔓延的“政治瘟疫”。因此,有人把恐怖主義和環(huán)境污染、政治腐敗并稱為21世紀(jì)的人類生存與發(fā)展所面臨的三大人為災(zāi)難。如何有效地防范恐怖主義,維護社會的穩(wěn)定和發(fā)展已成為世界各國共同關(guān)注的焦點問題。 中國新疆地處中亞地區(qū)的中心,因受歷史遺留問題和民族問題、宗教信仰差異等諸多因素的影響,新疆境內(nèi)的“民族分裂主義”和“宗教極端主義”歷來都十分猖獗。近年來,一些中亞國家接連發(fā)生“顏色革命”的社會變革,境外“三股勢力”也日益加大了對新疆地區(qū)的滲透。在此影響下,新疆地區(qū)的民族極端分子和宗教極端分子蠢蠢欲動,試圖在新疆開展一場新的“顏色革命”,妄圖推翻現(xiàn)行政權(quán)建立獨立的“國家”。新疆地區(qū)的恐怖主義犯罪活動進入了一個新的活躍期。此后,在新疆地區(qū)爆發(fā)了一系列的恐怖主義犯罪事件。其中,2009年7月5日晚發(fā)生在新疆自治區(qū)首府烏魯木齊市的嚴(yán)重“打砸搶燒”暴力犯罪事件,血淋淋地彰顯出新疆恐怖主義的殘暴和野心。這次暴力犯罪事件給新疆人民帶來沉重而深遠(yuǎn)的災(zāi)難,也進一步促使社會民眾意識到所面臨的恐怖主義威脅,強烈渴望一個安全穩(wěn)定的社會環(huán)境。 目前,學(xué)界對新疆恐怖主義犯罪的研究較多地局限在把其簡單地等同于國際上一般意義的恐怖主義犯罪,陳舊地從刑法學(xué)角度對其進行現(xiàn)狀、原因和防治對策等常規(guī)問題的研究,新的研究視角如根據(jù)新疆地區(qū)政治、經(jīng)濟、社會、文化、民族和宗教信仰等角度的多學(xué)科性研究略顯不足。因此,本文側(cè)重于以新疆的地緣因素為基礎(chǔ),從一個新層面特別是從社會根源層面對新疆恐怖主義犯罪進行更為全面、深入的研究,有針對性地提出建立新疆反恐防范機制的建議和策略。這對于新疆社會的穩(wěn)定和發(fā)展有著重要的現(xiàn)實意義和理論指導(dǎo)意義。 對于恐怖主義的定義,國際社會和法學(xué)界有著多種說法。雖然經(jīng)過多方長期的努力,但由于利益角度和標(biāo)準(zhǔn)的不同,至今仍無法對恐怖主義作出一致的界定。因此,本文首先在論述恐怖主義各種定義的基礎(chǔ)上,提出筆者對恐怖主義定義的理解和界定。本文研究目的是為防范新疆恐怖主義提出建議,因此簡要介紹了中亞地區(qū)和新疆恐怖主義的現(xiàn)狀及特點,然后結(jié)合新疆的地緣因素,并以新疆“7.5”事件為切入點,分析新疆地域性的政治、經(jīng)濟、文化、民族、宗教等社會因素,初步論述新疆恐怖主義的本質(zhì)特性,進而研究新疆恐怖主義發(fā)生社會根源。最后,結(jié)合目前國際社會特別是中亞國家在建立反恐防范機制中的先進經(jīng)驗和存在的主要問題,從幾個不同的角度提出建立新疆反恐防范機制具有針對性和可操作性的建議和策略。
[Abstract]:At present , in the international context , the frequent occurrence of terrorist crime has seriously jeopardized world peace and development . The terrorist crime often induces some regional wars , instigates armed factions ' conflicts , and creates large - scale casualties . It is a continuing " political plague . " Therefore , it is a disaster for the three adults facing terrorism and environmental pollution , political corruption and human existence and development called the 21st century . How to effectively prevent terrorism and maintain social stability and development has become a focus issue of common concern to all countries of the world .


In recent years , ethnic extremists and religious extremists in Xinjiang have become more and more rampant . At present , the study of Xinjiang ' s terrorism crime is limited by the study of the general problems such as the current situation , the reasons and the prevention and cure of Xinjiang ' s terrorism crime . The new research angle is based on the geographical factors of Xinjiang . Therefore , this paper focuses on the study of Xinjiang ' s terrorism crime from the perspective of politics , economy , society , culture , nationality and religion .


On the basis of discussing the definition of terrorism , this paper gives a brief account of the present situation and characteristics of terrorism in Xinjiang and analyzes the social factors such as politics , economy , culture , nationality and religion in Xinjiang .
