【摘要】：因其殖民歷史、地理位置和對勞動力的大量需求,歐洲在二戰(zhàn)后成為了大量移民的輸入地。在歐洲一體化的過程中,超國家層面的移民政策也取得了諸多成果,逐漸形成了歐洲共同移民政策。然而2015年以來大量難民涌入歐洲,歐盟難以采取有效措施,陷入了決策困境。在此背景下,本文回顧了歐洲一體化在移民和難民領(lǐng)域的發(fā)展歷程。從1985年簽訂《申根條約》開始,歐洲共同移民政策的進展艱難且緩慢。直至現(xiàn)在,歐盟仍然和其成員國共同享有在移民領(lǐng)域的決策權(quán)限,并且后者發(fā)揮著主導(dǎo)作用。自難民危機爆發(fā)以來,歐盟和成員國仍未能就危機采取統(tǒng)一的應(yīng)對方案,難民危機愈演愈烈。在難民危機的管理中,歐盟所制定的難民分?jǐn)偡桨�、歐土難民協(xié)議等政策工具在實際運作中失靈。此外,難民危機在其他領(lǐng)域的"外溢效應(yīng)"使整個歐洲一體化的前景都蒙上了陰影。為了對難民危機的解決以及政策的改革提供有效建議,本文對歐盟移民政策框架進行了一次全面、深入的評估,探尋決策困境背后歐盟移民和難民政策存在的結(jié)構(gòu)性缺陷。依據(jù)"政策循環(huán)"的思路,本文對議程設(shè)置、政策制定和執(zhí)行評估這三個決策環(huán)節(jié)分別進行了分析。在此基礎(chǔ)上,本文嘗試提供一些未來發(fā)展的改革建議。這不但可以幫助歐盟決策者迅速采取措施解決難民危機,同時也將為歐盟移民政策的長期發(fā)展與改革提供參考。
[Abstract]:Because of its colonial history, geographical location and massive demand for labor, Europe became an importer of large numbers of immigrants after World War II. In the process of European integration, supranational immigration policies also yielded many results. A common European immigration policy has gradually been formed. However, with the influx of refugees into Europe since 2015, the European Union has been in a difficult position to take effective measures and become a decision maker. This paper reviews the development of European integration in the field of immigration and refugees. Since the signing of the Treaty of Schengen in 1985, the progress of the European Common Migration Policy has been difficult and slow. The European Union and its member states still share decision-making powers in the field of migration, and the latter play a leading role. Since the outbreak of the refugee crisis, the European Union and member States have failed to adopt a unified response to the crisis. The refugee crisis intensified. In the management of the refugee crisis, policy instruments such as the European Union's refugee sharing scheme and the Europe-Turkey Refugee Agreement have failed in practice. The "spillover effect" of the refugee crisis in other fields has cast a shadow over the prospect of European integration. In order to provide effective advice on the solution of the refugee crisis and policy reform, this paper makes a comprehensive study of the European Union's immigration policy framework. To explore the structural shortcomings of EU immigration and refugee policies behind the decision-making dilemma. According to the idea of "policy cycle", this paper sets the agenda. On the basis of this, this paper tries to provide some reform suggestions for future development. This will not only help EU decision makers to take prompt measures to resolve the refugee crisis. At the same time, it will also provide a reference for the long-term development and reform of EU immigration policy.
