【摘要】：全球化的發(fā)展加深了各民族國家之間的關(guān)系,促進(jìn)了國家之間的合作與來往,促使跨國公司在全球范圍內(nèi)配置資源開展投資,生產(chǎn)經(jīng)營,開展經(jīng)濟(jì)活動,推動了人類文明和社會繁榮發(fā)展。分析跨國公司對國家主權(quán)的挑戰(zhàn)與國家的應(yīng)對,要明確全球化的發(fā)展是跨國公司成長發(fā)展的基礎(chǔ)。國家主權(quán)原則是處理國際關(guān)系的核心原則和特征。隨著全球化發(fā)展,國家之間聯(lián)系密切,相互依存加深,跨國公司得到迅猛發(fā)展。然而隨著跨國公司不斷發(fā)展壯大,成為了當(dāng)今世界經(jīng)濟(jì)、科技與國際關(guān)系中最活躍,最具影響力的力量,在給世界各國帶來益處的同時(shí),為了實(shí)現(xiàn)其全球策略,最大程度的獲取各方面利益,通過各種方式越來越多的介入國家活動,國家主權(quán)受到了巨大的挑戰(zhàn)。當(dāng)今世界,跨國公司對國家主權(quán)的挑戰(zhàn)是多方面的,本篇論文主要從跨國公司和國家主權(quán)的概念出發(fā),以母國和東道國角度,圍繞經(jīng)濟(jì)主權(quán)、政治主權(quán)和文化主權(quán)三個(gè)方面分析跨國公司對國家主權(quán)的挑戰(zhàn),并以母國和東道國角度分別從經(jīng)濟(jì)主權(quán)、政治主權(quán)和文化主權(quán)三方面提出了應(yīng)對跨國公司挑戰(zhàn)的相應(yīng)對策。本文主要采用了文獻(xiàn)研究、比較分析、理論與實(shí)際相結(jié)合的研究方法。除了第一章引言之外,主要還包括四個(gè)部分。第一部分主要介紹了跨國公司的發(fā)展、基本概念、民族性與國家性的兩大特性,以及國家主權(quán)的起源與發(fā)展,國家主權(quán)特征以及國家主權(quán)在經(jīng)濟(jì),政治,文化層面的體現(xiàn)。第二部分主要分析跨國公司對母國主權(quán)的挑戰(zhàn)與母國的應(yīng)對。分別從經(jīng)濟(jì)、政治、文化方面分析跨國公司對母國主權(quán)的挑戰(zhàn)與母國的應(yīng)對。第三部分主要分析跨國公司對東道國主權(quán)的挑戰(zhàn)與東道國的應(yīng)對。分別從經(jīng)濟(jì)、政治、文化方面分析跨國公司對東道國主權(quán)的挑戰(zhàn)與東道國的應(yīng)對。第四部分主要為結(jié)語,總結(jié)全文,在這一部分,強(qiáng)調(diào)國家主權(quán)并沒有喪失!分析跨國公司對民族國家的作用和貢獻(xiàn),跨國公司與民族國家相互依存實(shí)現(xiàn)雙贏,提出積極應(yīng)對跨國公司,理性看待國家主權(quán),引導(dǎo)跨國公司趨利避害,用全球化的眼光看國家主權(quán)維護(hù)國家利益。在全球化背景下,跨國公司的飛速發(fā)展已然成一種現(xiàn)象,跨國公司挑戰(zhàn)國家主權(quán)也成為當(dāng)今時(shí)代的顯著特征。全球化的浪潮下,跨國公司和民族國家在國際環(huán)境中共同發(fā)揮著作用,但國家主權(quán)并沒有喪失,這表明跨國公司絕不可能對國家主權(quán)肆意提出挑戰(zhàn),國家主權(quán)仍然是國家處理國際關(guān)系的基本權(quán)利與核心原則。民族國家需維護(hù)本國主權(quán),正確對待、處理與跨國公司之間的關(guān)系,權(quán)衡利弊,使跨國公司更有利于各國在全球化進(jìn)程中的發(fā)展。
[Abstract]:The development of globalization has deepened relations among nation-States, promoted cooperation and interaction among States, and encouraged transnational corporations to allocate resources for investment, production and economic activities on a global scale, Has contributed to the prosperity and development of human civilization and society. It has analysed the challenges posed by transnational corporations to national sovereignty and the responses of States, It must be made clear that the development of globalization is the basis for the growth and development of transnational corporations. The principle of State sovereignty is the core principle and characteristic of dealing with international relations. However, with the continuous development of transnational corporations, they have become the most active and influential forces in the world economy, science and technology and international relations, while bringing benefits to all countries in the world. In order to achieve its global strategy, maximize the benefits of all aspects, through a variety of ways more and more involvement in national activities, national sovereignty has been greatly challenged. In today's world, transnational corporations challenge national sovereignty in many ways. Starting from the concept of transnational corporation and state sovereignty, this paper analyzes the challenges of transnational corporations to national sovereignty from the perspectives of home country and host country, focusing on three aspects: economic sovereignty, political sovereignty and cultural sovereignty. And from the point of view of home country and host country, this paper puts forward the corresponding countermeasures to deal with the challenges of multinational corporations from the aspects of economic sovereignty, political sovereignty and cultural sovereignty respectively. In addition to the introduction of the first chapter, there are four main parts. The first part mainly introduces the development, basic concepts, national and national characteristics of multinational corporations. And the origin and development of national sovereignty, the characteristics of national sovereignty and the embodiment of national sovereignty in the aspects of economy, politics and culture. The third part mainly analyzes the challenges to the sovereignty of the host country and the response of the host country. The fourth part is the conclusion, summing up the full text, in this part, emphasizes that the national sovereignty has not been lost! This paper analyzes the role and contribution of transnational corporations to the nation-state, realizes the win-win situation between the transnational corporations and the nation-state, and puts forward the positive response to the transnational corporations, the rational treatment of the state sovereignty, and the guidance of the transnational corporations to seek advantages and avoid the disadvantages. In the context of globalization, the rapid development of transnational corporations has become a phenomenon, and the challenge of national sovereignty by transnational corporations has become a remarkable feature of the times. The fact that transnational corporations and nation-States jointly play a role in the international environment, but that national sovereignty has not been lost, shows that transnational corporations cannot arbitrarily challenge national sovereignty, National sovereignty remains the fundamental right and core principle of the State in dealing with international relations. The nation-State needs to safeguard its own sovereignty, treat it correctly, and balance the advantages and disadvantages of its relations with transnational corporations, To make multinational companies more conducive to the development of countries in the process of globalization.
