【摘要】：國際恐怖主義事件頻頻的發(fā)生,恐怖主義手段不斷的升級,不僅造成大量的人員傷亡和財產(chǎn)損失,更加劇了國際局勢的緊張,對世界各國的安全與穩(wěn)定構(gòu)成了嚴(yán)重威脅。國際社會對此普遍關(guān)注,紛紛采取了大量的措施予以打擊和防范,但是恐怖主義的囂張氣焰不但沒有減弱反而愈演愈烈。針對這一態(tài)勢,本文從國際法角度對國際恐怖主義及反恐措施加以分析和研究,并提出自己的一些建設(shè)性意見,希望能夠?qū)H反恐事業(yè)貢獻(xiàn)一點綿薄之力。 本文共分為四章。 第一章:國際恐怖主義概述。本章從恐怖主義的定義和特征入手,分析恐怖主義的基本理論,并闡述恐怖主義產(chǎn)生的根源及其發(fā)展趨勢。 第二章:國際反恐現(xiàn)狀及問題評析。本章通過現(xiàn)有的國際公約和區(qū)域性公約及其規(guī)定的相關(guān)措施對國際反恐現(xiàn)狀進(jìn)行概述,指出國際反恐措施中主要存在以下問題和缺陷:一是反恐立法分散,缺乏統(tǒng)一性,二是反恐措施實際運行效果不佳,三是反恐措施忽視對人權(quán)的保護(hù)。 第三章:加強(qiáng)和完善國際反恐措施的建議。本章針對國際恐怖措施存在的問題提出了以下建議,并對其展開詳細(xì)的闡述:一是開展全球性的國際反恐合作,二是制定并通過一部統(tǒng)一的國際反恐公約,三是明確聯(lián)合國的主導(dǎo)地位和核心作用,四是打擊國際恐怖主義應(yīng)當(dāng)兼顧到人權(quán)的保護(hù),五是解決國際恐怖主義的根源問題,做到標(biāo)本兼治。 第四章:我國反恐措施及完善。綜合闡述我國國內(nèi)的反恐措施,并在此基礎(chǔ)上針對其存在的問題提出以下完善的意見:一是完善與反恐有關(guān)的國內(nèi)立法,二是加強(qiáng)國際間的反恐合作,三是制定與反恐有關(guān)的專門立法。
[Abstract]:The frequent occurrence of international terrorist incidents and the continuous escalation of terrorist means not only caused a large number of casualties and property losses, but also increased tensions in the international situation. It poses a serious threat to the security and stability of all countries in the world. The international community is generally concerned about this, and has taken a large number of measures to combat and prevent it. However, the arrogance of terrorism has not been abated but has intensified. In view of this situation, this paper analyzes and studies international terrorism and counter-terrorism measures from the angle of international law, and puts forward some constructive suggestions. I hope to contribute a little bit to the international anti-terrorism cause. This paper is divided into four chapters. Chapter 1: Overview of international terrorism. This chapter starts with the definition and characteristics of terrorism, analyzes the basic theory of terrorism, and expounds the origin and development trend of terrorism. Chapter II: analysis of the current situation and problems of international counter-terrorism. This chapter summarizes the current situation of international counter-terrorism through existing international conventions and regional conventions and their related measures. It is pointed out that the main problems and defects in international counter-terrorism measures are as follows: first, the anti-terrorism legislation is dispersed and lack of uniformity; second, the actual operation effect of anti-terrorism measures is not good; third, counter-terrorism measures neglect the protection of human rights. Chapter III: suggestions for strengthening and perfecting international counter-terrorism measures. This chapter puts forward the following suggestions for the problems existing in international terrorism measures, and elaborates them in detail: first, to carry out global international counter-terrorism cooperation, The second is to formulate and adopt a unified international anti-terrorism convention, the third is to clarify the leading position and central role of the United Nations, the fourth is that the protection of human rights should be taken into account in the fight against international terrorism, and the fifth is to address the root causes of international terrorism. To treat both symptoms and symptoms. Chapter 4th: China's counter-terrorism measures and consummation. Comprehensive elaboration of our domestic counter-terrorism measures, and on this basis, the following suggestions are put forward: first, to improve domestic legislation related to counter-terrorism, Second, strengthen international anti-terrorism cooperation, third, formulate special legislation related to anti-terrorism.
