【摘要】：近年來,索馬里海盜活動日益猖獗,亞丁灣已成為全球海盜最活躍的地區(qū),直接威脅國際海運貿(mào)易的正常運行及國際社會的共同利益。聯(lián)合國先后出臺若干份決議授權(quán)各國赴索馬里海域打擊海盜活動,國際社會也做出了一定的努力,但在實際操作中還面臨著諸多難題。 索馬里海盜的頻繁作案也嚴(yán)重影響了我國的海運安全和經(jīng)濟利益,我國分別從軍事、政治及經(jīng)濟三方面出臺政策予以應(yīng)對,尤其是2008年底派遣軍艦前往亞丁灣護(hù)航,具有重要的意義。同時,在打擊索馬里海盜的具體政策實施上,無論是國際社會還是我國政府的努力都面臨著效用性低的困境。 本文旨在通過探討索馬里海盜的特點及國際社會已采取的相關(guān)措施,著重分析中國派遣軍艦護(hù)航這一代表性措施的原因及意義,并從法制、經(jīng)濟、軍事等方面提出能夠有效打擊索馬里海盜的對策建議。
[Abstract]:In recent years, Somali piracy has become increasingly rampant, and the Gulf of Aden has become the most active region of piracy in the world. It directly threatens the normal operation of international maritime trade and the common interests of the international community. The United Nations has successively issued a number of resolutions authorizing countries to go to the waters of Somalia to combat piracy, and the international community has also made certain efforts. But there are still many problems in practice. The frequent crimes committed by Somali pirates have also seriously affected the maritime security and economic interests of our country. Our country separately issued policies from the military, political and economic aspects to deal with them, especially the dispatch of warships to the Gulf of Aden to escort them in end of 2008. At the same time, the efforts of both the international community and our government are faced with a dilemma of low effectiveness in the implementation of specific policies to combat Somali piracy. The purpose of this paper is to discuss the characteristics of Somali pirates and the relevant measures taken by the international community, and to analyze emphatically the reasons and significance of the representative measures of China's sending warships to escort ships, and from the perspective of the legal system and the economy, Military and other aspects can effectively combat Somali piracy countermeasures.
