【摘要】：當(dāng)前,我國(guó)正處于社會(huì)轉(zhuǎn)型的大背景下,在帶來(lái)機(jī)遇與挑戰(zhàn)的同時(shí)也產(chǎn)生了很多社會(huì)不穩(wěn)定因素,各種社會(huì)矛盾不斷凸顯、積聚,醫(yī)患沖突便是其典型代表之一。醫(yī)患沖突的頻發(fā),不僅影響了醫(yī)患間的和諧信任關(guān)系,更有損我國(guó)醫(yī)療衛(wèi)生事業(yè)的健康發(fā)展,甚至與我國(guó)構(gòu)建社會(huì)主義和諧社會(huì)的目標(biāo)背道而馳。隨著我國(guó)對(duì)治理醫(yī)患沖突,構(gòu)建和諧互信醫(yī)患關(guān)系的不斷重視,對(duì)涉醫(yī)違法犯罪行為的嚴(yán)厲打擊、對(duì)保護(hù)醫(yī)患雙方合法權(quán)益決心的日益強(qiáng)化,國(guó)家上下各部門多措并舉,社會(huì)多主體協(xié)同共治,醫(yī)患沖突的治理已經(jīng)取得一定積極成效。但是現(xiàn)實(shí)當(dāng)中卻依然存在著一些不和諧因素,醫(yī)患沖突問(wèn)題并沒(méi)有得以根本解決。醫(yī)患之和,是社會(huì)之福;醫(yī)患失和,則兩敗俱傷。因此,如何正確認(rèn)識(shí)醫(yī)患沖突,找到?jīng)_突問(wèn)題產(chǎn)生的原因,并提出行之有效的治理路徑,對(duì)于我國(guó)改善醫(yī)患關(guān)系,維護(hù)正常醫(yī)療秩序,從而保持社會(huì)的和諧與穩(wěn)定有著重要的理論和實(shí)踐意義。本文將以社會(huì)沖突理論為支撐,試圖為我國(guó)治理醫(yī)患沖突問(wèn)題提供一個(gè)新的研究視角與治理路徑選擇。首先,以時(shí)間脈絡(luò)和法規(guī)政策為線索,通過(guò)對(duì)不同時(shí)間段內(nèi)醫(yī)患關(guān)系的格局特征及演變過(guò)程的分析梳理,找到產(chǎn)生沖突的動(dòng)機(jī)緣起,發(fā)現(xiàn)沖突轉(zhuǎn)化升級(jí)的動(dòng)態(tài)變化,梳理出醫(yī)患沖突多元主體的構(gòu)成現(xiàn)狀,為醫(yī)患沖突的原因分析提供切入點(diǎn)。其次,根據(jù)社會(huì)沖突理論的邏輯架構(gòu),以醫(yī)患沖突治理的不同階段和深度層次為依據(jù),從沖突處置、沖突化解和沖突轉(zhuǎn)化三個(gè)動(dòng)態(tài)發(fā)展的過(guò)程,找到導(dǎo)致醫(yī)患沖突問(wèn)題形成根本癥結(jié)。最后,從建立健全治理醫(yī)患沖突問(wèn)題的針對(duì)性法規(guī)政策、建立多渠道多層次多元化的醫(yī)患沖突化解體系、形成對(duì)醫(yī)患沖突問(wèn)題多元治理的廣泛共識(shí)三個(gè)層次,形成一個(gè)由表及里,從淺到深的多元立體化治理架構(gòu),共解醫(yī)患沖突問(wèn)題,重塑醫(yī)患間信任關(guān)系,維護(hù)醫(yī)療秩序的和諧穩(wěn)定。
[Abstract]:At present, our country is in the background of social transformation, which not only brings opportunities and challenges, but also produces a lot of social instability factors. All kinds of social contradictions continue to highlight and accumulate. Doctor-patient conflict is one of its typical representatives. The frequent conflict between doctors and patients not only affects the harmonious trust relationship between doctors and patients, but also undermines the healthy development of medical and health care in our country, and even runs counter to the goal of building a harmonious socialist society in our country. With the continuous attention of our country to the management of doctor-patient conflict, the construction of harmonious and mutual trust doctor-patient relationship, the severe crackdown on illegal and criminal acts involving doctors and patients, the increasing strengthening of the determination to protect the legitimate rights and interests of both doctors and patients, the simultaneous management of various departments in the country, the coordinated co-management of social subjects, and the management of doctor-patient conflict, the management of doctor-patient conflict has achieved some positive results. However, there are still some disharmonious factors in reality, and the problem of doctor-patient conflict has not been fundamentally solved. The sum of doctors and patients is a blessing to society; if doctors and patients break up, they lose both sides. Therefore, how to correctly understand the conflict between doctors and patients, find out the causes of the conflict, and put forward an effective governance path is of great theoretical and practical significance for improving the relationship between doctors and patients, maintaining the normal medical order, and thus maintaining the harmony and stability of society. Based on the theory of social conflict, this paper attempts to provide a new research perspective and choice of governance path for the management of doctor-patient conflict in China. First of all, taking the time context and laws and regulations as clues, through the analysis of the pattern characteristics and evolution process of doctor-patient relationship in different time periods, this paper finds out the motivation of conflict, finds out the dynamic changes of conflict transformation and escalation, combs out the present situation of the composition of multiple subjects of doctor-patient conflict, and provides a starting point for the analysis of the causes of doctor-patient conflict. Secondly, according to the logical structure of social conflict theory, based on the different stages and depth levels of doctor-patient conflict management, from the three dynamic development processes of conflict management, conflict resolution and conflict transformation, the fundamental crux of the problem leading to doctor-patient conflict is found. Finally, from establishing and perfecting the targeted laws and policies for the management of doctor-patient conflicts, establishing a multi-channel and multi-level and diversified doctor-patient conflict resolution system, forming a broad consensus on the pluralistic management of doctor-patient conflicts, forming a pluralistic three-dimensional governance structure from the surface to the inside, from shallow to deep, co-resolving the conflict between doctors and patients, reshaping the trust relationship between doctors and patients, and maintaining the harmony and stability of medical order.
