【摘要】：通過運(yùn)用文獻(xiàn)分析方法對非營利組織的相關(guān)理論進(jìn)行了研究,總結(jié)了目前非營利組織發(fā)展中的諸多外部優(yōu)勢和其自身在提供公共服務(wù)、改善社會環(huán)境等方面所表現(xiàn)出的廣泛性、公共性等優(yōu)勢。主要目的在于通過分析其在目前發(fā)展中存在的缺陷,究其根本原因,并研究發(fā)達(dá)國家或地區(qū)發(fā)展的模式和成功路徑,在此基礎(chǔ)上,結(jié)合我國非營利組織的自身特征達(dá)到尋求改善現(xiàn)狀路徑的目的。對國內(nèi)外關(guān)于非營利組織的理論以及國內(nèi)外的相關(guān)分類進(jìn)行了總結(jié)和闡述。通過分析和總結(jié),對我國非營利組織存在的法律規(guī)范不健全、籌資渠道不暢通造成的資金匱乏、內(nèi)外監(jiān)管主體作用不明顯等問題進(jìn)行了較為全面的研究和論述,對其外在困境和內(nèi)部不足進(jìn)行了研究,并闡明其產(chǎn)生以上問題的原因,通過問題找原因,繼而更有目的性的尋找解決方法。其次,運(yùn)用對比分析方法對發(fā)達(dá)國家和地區(qū)非營利組織發(fā)展的現(xiàn)狀,得出發(fā)達(dá)國家對非營利組織在法律地位上的重視、多元化的籌資模式、監(jiān)管制度的健全等先進(jìn)經(jīng)驗(yàn),從中找出目前我國非營利組織存在的差距,在此基礎(chǔ)上,得出我國應(yīng)采用集中立法模式盡快制定統(tǒng)一的非營利組織法、運(yùn)用營銷手段豐富籌資渠道、健全組織的外部監(jiān)管和內(nèi)部監(jiān)管主體等。運(yùn)用案例分析方法,對壹基金組織的建立、困境、轉(zhuǎn)型及其轉(zhuǎn)型的動力進(jìn)行了分析,得出其成功轉(zhuǎn)型的根本原因在于自身的不懈努力和政府的大力支持。
[Abstract]:By using the method of literature analysis, this paper studies the relevant theories of non-profit organizations, sums up many external advantages in the development of non-profit organizations and their extensive performance in providing public services, improving the social environment, and so on. Advantages such as publicity. The main purpose is to analyze its defects in the current development, to investigate its root causes, and to study the mode and successful path of the development of developed countries or regions, on this basis, Combined with the self-characteristics of non-profit organizations in China, we can find a way to improve the status quo. The theory of non-profit organization at home and abroad and the relevant classification at home and abroad are summarized and expounded. Through the analysis and summary, this paper makes a comprehensive study and discussion on the legal norms of the non-profit organizations in China, the lack of funds caused by the lack of funding channels, and the inconspicuous role of the internal and external regulatory subjects, and so on. This paper studies its external predicament and internal deficiency, and clarifies the causes of the above problems, finds out the reasons through the problems, and then finds out the solutions with more purpose. Secondly, using the method of comparative analysis to the status quo of the development of the non-profit organizations in developed countries and regions, the advanced experience of the developed countries in the legal status of non-profit organizations, the diversified financing model, the sound regulatory system, and so on, are drawn. On this basis, it is concluded that our country should adopt the centralized legislation mode to formulate the unified non-profit organization law as soon as possible, and enrich the financing channels by means of marketing, and then find out the gap between the non-profit organizations and the non-profit organizations in our country at present. Improve the external and internal supervision of the organization, and so on. By using the method of case analysis, this paper analyzes the foundation, predicament, transformation and its motive force of one Foundation, and concludes that the fundamental reason for its successful transformation lies in its unremitting efforts and the strong support of the government.
