公共產(chǎn)權(quán)的社會(huì)界定及其地方實(shí)踐——以S鎮(zhèn)村民的“采砂行為”為例

【摘要】：從產(chǎn)權(quán)社會(huì)學(xué)視角出發(fā),公共產(chǎn)權(quán)的界定是一個(gè)社會(huì)過程,涉及政府、企業(yè)、民眾等多個(gè)界定主體,受到國(guó)家層面的正式法律、科層體制的運(yùn)行機(jī)制、民間社會(huì)的文化規(guī)范等多重制度邏輯的共同影響。面對(duì)政治風(fēng)險(xiǎn)和社會(huì)風(fēng)險(xiǎn)的雙重壓力,地方政府必須合理界定公共產(chǎn)權(quán)并有效治理產(chǎn)權(quán)占有帶來的困境。有效治理的背后是場(chǎng)域內(nèi)部各行動(dòng)主體運(yùn)用各種策略相互博弈的結(jié)果。在博弈過程中,面對(duì)與博弈者相關(guān)的治理權(quán)分配、治理實(shí)踐以及成員權(quán)這三種權(quán)利而展開的博弈,積極磋商和行政變通等成為地方政府的基本策略,而彰顯生存正義和公平原則則是民眾的應(yīng)對(duì)策略。本文以M江邊上S鎮(zhèn)村民的采砂行為體現(xiàn)出的公共產(chǎn)權(quán)占有為例,以公共產(chǎn)權(quán)界定的多重邏輯為分析框架,來呈現(xiàn)公共產(chǎn)權(quán)界定背后的多重機(jī)制和相互作用過程的復(fù)雜性,從而對(duì)地方政府的治理實(shí)踐做出社會(huì)學(xué)的解釋。
[Abstract]:From the perspective of sociology of property rights, the definition of public property right is a social process, involving the government, enterprises, people and other defining subjects. Civil society's cultural norms and other multiple institutional logic of the common impact. Faced with the double pressure of political risk and social risk, the local government must reasonably define the public property right and effectively manage the predicament caused by the ownership of property right. The effective governance is the result of the game between the actors in the field using various strategies. In the process of the game, in the face of the game of the distribution of governance rights, the practice of governance and the rights of members, active consultation and administrative flexibility become the basic strategies of the local government. And the principle of justice and fairness is the public's coping strategy. In this paper, taking the sand mining behavior of villagers in S Town on the edge of M River as an example, taking the multiple logic of the definition of public property right as the analysis frame, the paper presents the complexity of the multiple mechanism and interaction process behind the definition of public property right. Thus the local government's governance practice to make a sociological explanation.
