【摘要】：官辦NGO是中國社會組織的重要組成部分,但其大多行政色彩濃厚,效率低下,缺乏活力,亟待改革。學術界大致勾勒了三條改革路徑:國家法團主義的依附式發(fā)展,多元主義的去行政化,現(xiàn)實主義的官民調和。與前兩者相比較,相對折中的官民調和路徑,更具可行性且合乎政府轉型與社會發(fā)展的趨勢,但表述相對模糊。在明確并論證其"從國家法團主義到社會法團主義"的國家社會關系的前提判斷的基礎上,這條路徑可提煉概括為"從國家法團到社會法團"的改革路徑。該路徑在承認官辦NGO的法團地位與功能的基礎上,一方面以"借力"和"增量"的手段培育其社會化基礎與社會服務能力,另一方面通過逐步"放權"與"撤離"的方式降低其行政化比重,最終使其與政府的關系從基于領導的職能補充,轉向基于引導的功能合作。
[Abstract]:Government-run NGO is an important part of Chinese social organization, but most of it has strong administrative color, low efficiency and lack of vitality, so it is in urgent need of reform. The academic circles have outlined three reform paths: the dependent development of the national corporation doctrine, the deconcentration of pluralism and the reconciliation of the officials and the people with realism. Compared with the former two, the relative compromise between the government and the people is more feasible and in line with the trend of government transformation and social development, but the expression is relatively vague. On the basis of clear and argumentation of its premise judgment of "from the state corporation to the social corporation", this path can be summarized as the reform path from the state corporation to the social corporation. On the basis of acknowledging the status and function of the corporation of the government-run NGO, on the one hand, it cultivates its socialized foundation and social service ability by means of "borrowing power" and "increment". On the other hand, by gradually devolving power and withdrawing, the proportion of administration is reduced, and finally the relationship between the government and the government is changed from the function supplement based on leadership to the functional cooperation based on guidance.
