【摘要】：鄉(xiāng)規(guī)民約是中國傳統(tǒng)鄉(xiāng)村社會中衍生出來的一種原創(chuàng)制度,是治理鄉(xiāng)村的一種優(yōu)秀傳統(tǒng)。當(dāng)前繼續(xù)保持鄉(xiāng)規(guī)民約的生命力,既有利于發(fā)揮鄉(xiāng)規(guī)民約在鄉(xiāng)村治理中的作用,又有利于國家正式制度的有效運(yùn)行。鄉(xiāng)規(guī)民約是農(nóng)村研究領(lǐng)域中的重要問題,以研究者視角對鄉(xiāng)規(guī)民約理論的發(fā)展和演化進(jìn)行學(xué)術(shù)回顧與梳理。既有研究主要集中在鄉(xiāng)規(guī)民約的內(nèi)涵、歷史演變、性質(zhì)、特征、類型、功能、存在形態(tài)、文本結(jié)構(gòu)、主要內(nèi)容、效力基礎(chǔ)、權(quán)威來源等基本理論的研究,并從國家治理的視角來審視鄉(xiāng)規(guī)民約與國家法制的協(xié)調(diào)和整合。既有研究對鄉(xiāng)規(guī)民約的作用機(jī)制,對鄉(xiāng)紳和鄉(xiāng)約組織消失后鄉(xiāng)規(guī)民約的權(quán)威基礎(chǔ)、依托力量,參與鄉(xiāng)規(guī)民約治理的鄉(xiāng)村社會資源,治理績效、績效評估等問題研究不足。引入新的理論和視角創(chuàng)新鄉(xiāng)規(guī)民約的理論研究,基于依法治國的基本國策和國家治理體系構(gòu)建的視野,在國家硬法的框架下,筑牢鄉(xiāng)規(guī)民約等軟法治理的社會基礎(chǔ),引導(dǎo)鄉(xiāng)規(guī)民約的自我完善,與國家法良性互動,最終融入國家法律體系,是鄉(xiāng)規(guī)民約未來發(fā)展與創(chuàng)新的主要方向。
[Abstract]:Rural regulations is an original system derived from Chinese traditional rural society and an excellent tradition of rural governance. At present, keeping the vitality of rural regulations is not only conducive to giving full play to the role of rural regulations in rural governance, but also conducive to the effective operation of the country's formal system. Rural regulation is an important issue in the field of rural research. The development and evolution of rural regulation theory are reviewed and combed from the perspective of researchers. The existing studies mainly focus on the basic theories of the connotation, historical evolution, nature, characteristics, types, functions, forms of existence, text structure, main contents, basis of effectiveness, sources of authority, etc. And from the perspective of national governance to examine the coordination and integration of rural regulations and the national legal system. The existing research on the mechanism of the rural rules and regulations, the authoritative basis of the rural rules and regulations after the disappearance of the rural gentry and the rural treaty organizations, relying on the strength, participate in the rural social resources, governance performance, performance evaluation, etc. This paper introduces new theories and perspectives to innovate the theoretical study of rural regulations, based on the basic state policy of governing the country according to law and the vision of the construction of national governance system, and under the framework of national hard law, to build the social foundation of soft law governance, such as the rules of the township, and so on. It is the main direction of the future development and innovation to guide the self-improvement of the rural regulations, to interact with the state law, and finally to integrate into the national legal system.
