【摘要】：法律至上和道德本位的沖突、程序正義和實(shí)體正義的沖突以及職業(yè)理性與大眾情感的沖突,是司法與輿論沖突的內(nèi)在原因。緩解司法與輿論之間的沖突,須以兩者之間的有效溝通與內(nèi)在調(diào)和為必要條件,司法機(jī)關(guān)融理入判,在案件辦理中主動應(yīng)對可能的輿論壓力,是實(shí)現(xiàn)這一目的的內(nèi)在途徑。而做講理的裁判,就要順應(yīng)天理、合乎倫理、內(nèi)含情理,即以天理關(guān)照人性訴求,以倫理協(xié)調(diào)多元規(guī)范,以情理安撫世道人心,從而讓公眾從內(nèi)心接受司法所確認(rèn)的社會規(guī)范、所安排的生活方式以及所追求的價值目標(biāo)。
[Abstract]:The conflict between the supremacy of law and moral standard, the conflict between procedural justice and substantive justice, and the conflict between professional reason and public emotion are the internal causes of the conflict between judicature and public opinion. In order to alleviate the conflict between judicature and public opinion, the necessary condition must be the effective communication and internal harmony between them. It is the internal way for the judicial organs to deal with the possible pressure of public opinion and to deal with the possible pressure of public opinion in the handling of cases. To be a rational judge, one must conform to the principles of Heaven, be ethical, and contain reason. That is to say, by taking account of the demands of human nature by heaven and reason, by reconciling pluralistic norms with ethics, and comforting the people of the world with reason, the public can accept the social norms recognized by the judiciary from the heart of their hearts. The life style arranged and the value goal pursued.
