【摘要】：在美國,媒體報道因網(wǎng)絡(luò)欺凌而導(dǎo)致的青少年自殺或受到生理、心理傷害的事件屢見不鮮,美國各州也已經(jīng)陸續(xù)立法管制校園網(wǎng)絡(luò)欺凌。網(wǎng)絡(luò)欺凌是傳統(tǒng)校園欺凌在網(wǎng)絡(luò)上的延伸,又不乏新的特點(diǎn)。網(wǎng)絡(luò)欺凌的空間輻射范圍更廣,欺凌手段更具有隱蔽性,虛擬距離使得欺凌者難以預(yù)知欺凌行為造成的傷害,加之網(wǎng)絡(luò)欺凌的開放性與持續(xù)性特征,給應(yīng)對校園網(wǎng)絡(luò)欺凌帶來不小的挑戰(zhàn)。面對新形式的校園欺凌,學(xué)校管轄權(quán)的擴(kuò)大和管制手段的革新勢在必行,美國一些州在司法實(shí)踐中引入"實(shí)質(zhì)損害原則",同時呼吁引入旁觀者責(zé)任。校園網(wǎng)絡(luò)欺凌在我國尚處于蟄伏階段,美國應(yīng)對網(wǎng)絡(luò)欺凌的很多策略值得我們借鑒,但前攝性言論限制和旁觀者責(zé)任并不適合我國。
[Abstract]:In the United States , media reports that teenage suicide or physical and psychological harm caused by network bullying is common , and the states of the United States have already regulated the campus network bullying . The network bullying is the extension of traditional campus bullying on the network , and there are no new features . In the face of the new form of campus bullying , the expansion of school jurisdiction and the innovation of control means are imperative .
