【摘要】：城市生態(tài)系統(tǒng)是城市、空間與自然、環(huán)境等的動態(tài)統(tǒng)一,當(dāng)代城市生態(tài)系統(tǒng)面臨嚴(yán)峻挑戰(zhàn)。城市生態(tài)權(quán)利是城市生態(tài)系統(tǒng)穩(wěn)定與繁榮的重要基石,其內(nèi)涵可從生態(tài)倫理學(xué)、生態(tài)政治學(xué)、法理學(xué)等維度加以認(rèn)知。城市生態(tài)權(quán)利是對權(quán)利主體權(quán)益與責(zé)任的規(guī)定與整合,其本質(zhì)是對城市生態(tài)空間中人、自然、社會之間利益關(guān)系的確認(rèn)、調(diào)整與優(yōu)化,城市生態(tài)權(quán)利的實(shí)現(xiàn)需要生態(tài)權(quán)利意識、經(jīng)濟(jì)理性邏輯、權(quán)力運(yùn)行機(jī)制的深層轉(zhuǎn)換。建立一種符合生態(tài)正義、經(jīng)濟(jì)運(yùn)行規(guī)律、法律規(guī)制的城市生態(tài)權(quán)利話語體系,對于推進(jìn)城市生態(tài)權(quán)利和城市生態(tài)系統(tǒng)的健康發(fā)展具有重要的意義。
[Abstract]:Urban ecosystem is the dynamic unity of city, space, nature and environment, and the contemporary urban ecosystem is facing severe challenges. Urban ecological rights are the important foundation stone for the stability and prosperity of urban ecosystem, and its connotation can be derived from ecological ethics. Urban ecological right is the regulation and integration of rights, interests and responsibilities, and its essence is the confirmation, adjustment and optimization of the relationship between human, nature and society in urban ecological space. The realization of urban ecological rights needs the consciousness of ecological rights, the logic of economic rationality, the deep transformation of power operation mechanism, and the establishment of a discourse system of urban ecological rights, which conforms to the ecological justice, the law of economic operation and legal regulation. It is of great significance to promote the urban ecological rights and the healthy development of urban ecosystem.
