【摘要】：合理的流轉(zhuǎn)土地極大的提高了土地的利用效率。所以,土地流轉(zhuǎn)是社會發(fā)展到一定階段的客觀趨勢。然而,在我國不斷加快的工業(yè)化、城市化的背景下,農(nóng)村因土地流轉(zhuǎn)而導致的利益沖突現(xiàn)象日益增多,給我國社會可持續(xù)發(fā)展以及現(xiàn)代農(nóng)業(yè)建設(shè)造成隱患。因此,研究并化解農(nóng)村土地流轉(zhuǎn)的利益沖突十分必要。本文采取文獻研究與訪談相結(jié)合的方式,分為五部分來探討土地流轉(zhuǎn)利益沖突問題。緒論部分重點討論該選題的背景及意義,以及國內(nèi)外對該問題現(xiàn)有的研究綜述,陳述相關(guān)概念界定以及研究思路、方法。第一章主要從改革開放前后兩個階段來解讀土地流轉(zhuǎn)制度發(fā)展過程中曾經(jīng)出現(xiàn)的利益沖突問題。第二章總結(jié)了土地流轉(zhuǎn)四大利益主體之間的沖突,如農(nóng)民與農(nóng)民、農(nóng)民與村集體等不同主體之間的利益沖突,并進行歸納分析,第三章以我國當前土地流轉(zhuǎn)的基本理論制度為基礎(chǔ),通過查閱資料以及訪談,擬對土地流轉(zhuǎn)利益沖突的成因進行分析。第四章,從產(chǎn)權(quán)制度、流轉(zhuǎn)機制、收益分配制度、監(jiān)督機制以及社會保障機制等方面,結(jié)合土地制度相對來說較為成熟的日本、美國等國的經(jīng)驗,探究有利于我國農(nóng)村土地制度改革的若干啟示并提出一些探索性的建議。
[Abstract]:The reasonable circulation of land has greatly improved the efficiency of land use. Therefore, land circulation is the objective trend of social development to a certain stage. However, under the background of accelerating industrialization and urbanization in our country, the conflict of interest caused by land circulation in rural areas is increasing day by day, which brings hidden dangers to the sustainable development of our society and the construction of modern agriculture. Therefore, it is necessary to study and resolve the conflict of interest in rural land circulation. This paper adopts the combination of literature research and interview, which is divided into five parts to discuss the conflict of interest in land circulation. The introduction part focuses on the background and significance of the topic, as well as the existing research review of the issue at home and abroad, and states the definition of related concepts, research ideas and methods. The first chapter mainly interprets the conflict of interest in the development of land circulation system from the two stages before and after the reform and opening up. The second chapter summarizes the conflicts between the four major interest subjects of land circulation, such as the conflicts of interest between farmers and farmers, farmers and village collectives, and makes an induction and analysis. The third chapter is based on the basic theoretical system of land circulation in our country, through consulting data and interviews, the author intends to analyze the causes of the conflict of interest in land circulation. In the fourth chapter, from the aspects of property right system, circulation mechanism, income distribution system, supervision mechanism and social security mechanism, combined with the experience of Japan, the United States and other countries, which are relatively mature in the land system, this paper probes into some enlightenments and puts forward some exploratory suggestions which are beneficial to the reform of rural land system in our country.
