我國社會保險關系轉移接續(xù)問題的研究
[Abstract]:With the current speed of reform and opening up in China, the economy of China's social market is developing rapidly, and a large number of labor forces in various provinces and cities move to employment across provinces and cities, and this phenomenon has emerged. So that the transfer of social insurance relations to continue this work emerges as the times require. The transfer and succession of social insurance relations is a positive exploration to promote the leap-forward development of social insurance, and is related to the vital interests of the vast number of migrant employment personnel across provinces and cities. It also puts forward new requirements and challenges to the working ability of social insurance agencies. "interim measures for the transfer and succession of basic Endowment Insurance Relations for Urban Enterprise Workers promulgated and implemented by the State Council in 2010" and "Mobile Employment personnel" Interim measures for the transfer and succession of basic Medical Security Relations, Clear provisions have been made on the transfer and succession of basic old-age insurance and basic medical insurance for migrant employed personnel across provinces and cities, but these two interim measures only make institutional provisions on the transfer of social insurance relations among migrant employment personnel. But it cannot be a rule of law. Subsequently, the implementation of the Social Security Law on July 1, 2011 is of milestone significance in the cause of social security, which fills in the legal gap in the cause of social insurance in our country. It provides a legal basis for the transfer of social insurance relationship among migrant employees. However, the implementation of the two interim measures and the promulgation of a legal provision cannot solve the confusion of the overall planning level of social security in our country, the urban employee insurance and the urban and rural old-age insurance can not be seamlessly connected, and the information construction of the social security system is slow. The format of personal account accounting and the proportion of personal account amount are inconsistent and so on. The emergence of these problems has greatly damaged the social security rights and interests of migrant workers, cracked down on the enthusiasm of labor force moving employment across provinces and cities, hindered the development of market economy, and caused social instability. Based on the present situation of the transfer and succession of social insurance relationship in China, this paper analyzes the current social background, summarizes the significance of the study, and probes into the reasons why the transfer of social insurance relationship among mobile employment personnel in our country is not smooth. And the negative impact of these reasons on the whole society. In view of these problems, which lead to the unsmooth transfer of social insurance relations among migrant employees and drawing lessons from the research experience of some scholars at home and abroad, this paper puts forward some solutions and measures in line with the national conditions of our country. In order to meet the needs of a large number of cross-provincial migrant workers in China, create a fair and just employment environment for them, clear the stumbling blocks in the socialist economic construction of our country, and create a stable and harmonious economic society.
