【摘要】：[目的]研究集體土地所有權(quán)行使主體的明確與完善被征地農(nóng)民多元保障機(jī)制的路徑。[方法]運(yùn)用文獻(xiàn)梳理法,分析農(nóng)村集體土地所有權(quán)行使主體模糊引發(fā)"群體性事件"的現(xiàn)狀,揭示其在建立健全集體土地的所有權(quán)消極權(quán)能實(shí)現(xiàn)、權(quán)能夯實(shí)、管理權(quán)限行使與集體成員受益權(quán)能保護(hù)等農(nóng)民多元保障機(jī)制方面產(chǎn)生的負(fù)面影響;運(yùn)用邏輯歸納法,提出"集體土地所有權(quán)行使主體明確是多元保障機(jī)制完善的靈魂"。[結(jié)果]破解"有意制度模糊"必須從實(shí)體和程序制度上明確集體土地所有權(quán)行使主體,才能有效保證被征地農(nóng)民的多元利益。[結(jié)論]當(dāng)前改革已進(jìn)入攻堅(jiān)期與深水區(qū),農(nóng)村集體土地所有權(quán)行使主體模糊引發(fā)的"沖突和社會(huì)動(dòng)亂"等負(fù)性外部效應(yīng)也日益凸顯,完善被征地農(nóng)民的多元保障機(jī)制(即以集體土地所有權(quán)行使主體確立為靈魂,以使用權(quán)入市、征用征收公平補(bǔ)償、增值公平分配、財(cái)產(chǎn)性合法收入保障、社會(huì)保障為現(xiàn)實(shí)路徑)應(yīng)加快提上議事日程。
[Abstract]:[objective] to study the path to clear and perfect the multiple security mechanism of land expropriated farmers in the exercise of collective land ownership. [methods] using the method of literature combing, this paper analyzes the present situation of "group events" caused by the fuzzy subject of the exercise of rural collective land ownership, and reveals that it is establishing and perfecting the collective land ownership to realize the negative power and consolidate the power. The negative effects of the management authority exercise and the protection of collective members' benefit and power on the farmers' pluralistic security mechanism are put forward by using the logical induction method, and it is pointed out that "the collective land ownership exercise subject is the soul of the improvement of the pluralistic security mechanism". [results] in order to solve the ambiguity of intentional system, it is necessary to define the subject of collective land ownership from the substantive and procedural systems, so as to effectively guarantee the plural interests of the peasants who have been expropriated. [conclusion] the current reform has entered a critical period and deep water areas, and the negative external effects, such as "conflict and social unrest" caused by the fuzzy exercise of collective land ownership in rural areas, have become increasingly prominent. Perfecting the multiple security mechanism of the peasants who have been expropriated (that is, taking collective land ownership as the soul, taking the right to use into the market, expropriating fair compensation, adding value and fair distribution, property legal income security, etc.) Social security should be put on the agenda as soon as possible.
