【摘要】：近年來,救人被訛的事件屢屢發(fā)生。此類事件凸顯出的不僅僅是社會道德的滑坡,更多的是法律規(guī)制的缺失。西方國家的"好撒瑪利亞人法"已運行多年,并且取得了良好的社會效果,值得我國借鑒。在完善社會保障體系的同時,我國應(yīng)制定一部包含救助者的范圍界定、救助作為公民的一般義務(wù)、救助者的責(zé)任豁免、侵犯救助者合法權(quán)益的法律責(zé)任、舉證責(zé)任等內(nèi)容的全國性的保護救助者權(quán)益的"好人法",以解決目前我國社會"救不救"這一問題,維護社會和諧。
[Abstract]:In recent years, there have been many false incidents of saving lives. Such incidents highlight not only the decline of social morality, but also the lack of legal regulation. The "good Samaritan Law" in western countries has been running for many years and has achieved good social effect, which is worthy of our country's reference. At the same time of perfecting the social security system, our country should formulate a legal liability that includes the scope of the rescuer, the general obligation of the citizen, the exemption from the responsibility of the savior, and the infringement of the lawful rights and interests of the rescuer. The burden of proof and other contents of the national "good people Law" to protect the rights and interests of rescuers, in order to solve the problem of "whether to save" in our society at present, and to maintain social harmony.
