【摘要】：自全面建設社會主義市場經濟以來,我國的經濟和社會得到了很快的發(fā)展,人民的生活水平有了顯著的提高,各方面取得了卓越的成就。但在成績的背后,有一個無法忽視的問題,我國的貧富差距不斷加大,地域差距日益明顯。尤其在中西部地區(qū),弱勢群體的大量存在,不僅影響到社會穩(wěn)定和經濟發(fā)展,還阻礙了社會現(xiàn)代化的進程,更阻礙了我國經濟社會的全面發(fā)展。最低生活保障作為社會救助中最基本的生活需求保障,它的發(fā)展與社會弱勢群體的生存狀況息息相關。我國現(xiàn)行的居民最低生活保障制度經過十幾年的發(fā)展,發(fā)揮了巨大的作用,為許多貧困居民提供了基本的物質生存條件,但隨著社會各個方面情況的不斷變化,在縣級地區(qū),對弱勢群體救助方面的制度還存在著很大的不足,低保制度中存在的漏洞也日益顯現(xiàn)出來,而且該制度與廣大城鄉(xiāng)居民的切身利益息息相關。因此,加強對這些地區(qū)弱勢群體低保救助現(xiàn)狀的研究,可以為政府在制定針對縣鄉(xiāng)地區(qū)的政策法規(guī)和更好的開展低保救助工作提供理論依據,有利于維護社會穩(wěn)定。本文力圖通過對陽城縣低保制度的現(xiàn)狀進行調查研究,學習國際和發(fā)達城市的先進經驗,對比目前政策中的不足找出解決問題的對策。全文共有五個部分,先說明選題緣由、國內外研究現(xiàn)狀和調研思路、方法,再通過對所選調研地調研情況進行數(shù)據整理,從中總結調研地區(qū)低保救助的現(xiàn)狀,然后發(fā)現(xiàn)其中存在的問題,最后從法律角度對問題進行分析并且提出自己的一些淺見。在持續(xù)建設法治社會的進程中,政策規(guī)范和法律規(guī)范都應該在實踐工作中作為手段運用,就目前的情況來看,在完善低保制度的過程中,應當逐步的將“政策規(guī)范”轉化為“法律規(guī)范”,相關法律的完善能使低保制度更加高效的給予被救助者幫助,讓更多居民的權利更好的得到保障。
[Abstract]:Since the overall construction of socialist market economy, the economy and society of our country have been developed rapidly, the living standard of the people has been remarkably improved, and remarkable achievements have been made in all aspects. However, behind the achievements, there is a problem that can not be ignored. The gap between the rich and the poor is increasing, and the regional gap is becoming more and more obvious. Especially in the central and western regions, the existence of a large number of vulnerable groups not only affects the social stability and economic development, but also hinders the process of social modernization and the overall economic and social development of our country. As the most basic guarantee of life demand in social assistance, the development of minimum living security is closely related to the living conditions of social vulnerable groups. After more than ten years of development, the current minimum living security system of residents in China has played a great role in providing basic material living conditions for many poor residents, but with the constant changes in various aspects of society, it has been in county-level areas. There are still some shortcomings in the system of relief to the vulnerable groups, and the loopholes in the system of minimum living allowance are also becoming more and more obvious, and the system is closely related to the vital interests of the vast number of urban and rural residents. Therefore, to strengthen the study of the situation of the vulnerable groups in these areas can provide a theoretical basis for the government to formulate policies and regulations for county and township areas and better carry out the work of minimum living allowance, which is conducive to the maintenance of social stability. This paper attempts to study the current situation of Yangcheng County's minimum security system, study the advanced experience of international and developed cities, and find out the countermeasures to solve the problem by comparing the shortcomings of current policies. The full text has five parts, first explain the reason of the selected topic, domestic and foreign research status and research ideas, methods, and then through the selected research place survey data collation, from which to sum up the status quo of the research area of minimum living assistance. Then find out the existing problems, and finally analyze the problems from the legal point of view and put forward some simple views. In the process of continuously building a society ruled by law, both policy norms and legal norms should be used as a means in practice. As far as the present situation is concerned, in the process of perfecting the minimum security system, "Policy norms" should be gradually transformed into "legal norms", the improvement of relevant laws can make the system of minimum living allowance more efficient to help the assisted, so that more residents' rights can be better protected.
