【摘要】：陽(yáng)江是廣東粵西欠發(fā)達(dá)城市,在廣東促進(jìn)粵東西北發(fā)展背景下,陽(yáng)江著力推進(jìn)交通基礎(chǔ)設(shè)施建設(shè)、產(chǎn)業(yè)園區(qū)擴(kuò)容增效、中心城區(qū)擴(kuò)容提質(zhì),這需要大量的農(nóng)村土地來(lái)為項(xiàng)目提供用地,征地項(xiàng)目多,面積大,導(dǎo)致失地農(nóng)民數(shù)量增多。土地征收涉及多方利益,農(nóng)民是弱勢(shì)群體,在土地征收過(guò)程中利益受損嚴(yán)重,與政府的糾紛矛盾越來(lái)越多,研究陽(yáng)江市農(nóng)村土地征收中失地農(nóng)民權(quán)益保障問(wèn)題顯得迫切需要。本文采用文獻(xiàn)法、調(diào)查法、實(shí)證歸納研究法指出陽(yáng)江失地農(nóng)民的權(quán)益保障存在的問(wèn)題,并對(duì)問(wèn)題進(jìn)行分析,利用基礎(chǔ)理論及借鑒國(guó)內(nèi)外失地農(nóng)民權(quán)益保障做法,提出解決辦法。本文首先對(duì)失地農(nóng)民權(quán)益等核心概念進(jìn)行描述,介紹了社會(huì)保障、公平補(bǔ)償、利益博弈理論,其次描述陽(yáng)江失地農(nóng)民權(quán)益,包括經(jīng)濟(jì)權(quán)益、社會(huì)保障、政治利益、市民化服務(wù)權(quán)益,收集有關(guān)陽(yáng)江保障失地農(nóng)民權(quán)益的做法,如解決征地補(bǔ)償安置問(wèn)題,發(fā)展留用地、建立社會(huì)保障制度、多部門(mén)協(xié)調(diào)化解糾紛矛盾。然后指出陽(yáng)江失地農(nóng)民權(quán)益保障存在的問(wèn)題,即土地征收程序不規(guī)范,農(nóng)民參與度低,經(jīng)濟(jì)權(quán)益受損,社會(huì)保障水平不高、溝通渠道不暢,失地農(nóng)民融入城市困難。并對(duì)問(wèn)題進(jìn)行分析,介紹了國(guó)內(nèi)外城市失地農(nóng)民權(quán)益保障經(jīng)驗(yàn)教訓(xùn),最后結(jié)合相關(guān)理論并借鑒國(guó)內(nèi)外保障失地農(nóng)民權(quán)益的做法,探索符合陽(yáng)江的解決辦法,即規(guī)范征地程序、提高公眾的參與度,嚴(yán)格界定公共利益的范圍,提高征地補(bǔ)償標(biāo)準(zhǔn),創(chuàng)新安置方式;建立完善失地農(nóng)民社會(huì)保障體系,暢通失地農(nóng)民利益表達(dá)渠道,建立失地農(nóng)民利益代言人機(jī)制,同時(shí)推動(dòng)失地農(nóng)民市民化進(jìn)程,更好融入城市生活。
[Abstract]:Yangjiang is an underdeveloped city in western Guangdong. In the context of Guangdong's promotion of the development of northwest Guangdong, Yangjiang has made great efforts to promote the construction of transportation infrastructure, expand industrial parks and increase efficiency, and expand and improve quality in the central urban areas. This requires a large number of rural land to provide land for the project, land requisition projects, large area, resulting in an increase in the number of land-lost farmers. Land expropriation involves various interests, farmers are weak groups, interests are seriously damaged in the process of land expropriation, and there are more and more contradictions between land expropriation and government disputes. It is urgent to study the protection of the rights and interests of landless farmers in rural land expropriation in Yangjiang City. This paper points out the problems existing in the protection of the rights and interests of the landless peasants in Yangjiang by the methods of literature, investigation and empirical research, and analyzes the problems, and puts forward the solutions by using the basic theory and the practices of the protection of the rights and interests of the land-lost peasants at home and abroad for reference. This paper first describes the core concepts such as the rights and interests of landless farmers, and introduces the theory of social security, fair compensation and benefit game, and then describes the rights and interests of landless farmers in Yangjiang, including economic rights, social security, political interests, etc. In order to protect the rights and interests of the landless peasants in Yangjiang City, the author collects the measures such as solving the problem of compensation and resettlement of land requisition, developing the reserved land, establishing the social security system, and resolving the disputes in a coordinated and multi-departmental manner. Then it points out the problems existing in the protection of the farmers' rights and interests in Yangjiang, that is, the land expropriation procedure is not standardized, the farmers' participation is low, the economic rights and interests are damaged, the level of social security is not high, the communication channels are not smooth, and it is difficult for the landless peasants to integrate into the city. This paper also analyzes the problems, introduces the experience and lessons of the protection of the rights and interests of the land-lost farmers at home and abroad, and finally combines the relevant theories and practices of protecting the rights and interests of the land-lost peasants at home and abroad, and explores the solution that conforms to Yangjiang, that is, standardizing the procedures of land expropriation. To improve the participation of the public, strictly define the scope of public interest, improve the standard of compensation for land requisition, innovate the way of placement, establish and improve the social security system of land-lost farmers, and unblock the channels of expression of the interests of landless farmers, The mechanism of interest spokesman for landless farmers should be established, and the process of urbanization of landless farmers should be promoted, so as to better integrate into urban life.
