中越船員權(quán)利保障法律制度比較研究

【摘要】:航運業(yè)最重要的勞動力是在船上工作的海員隊伍。這是一個重要的不可或缺的要素;它還是直接影響航運企業(yè)乃至于整個海洋產(chǎn)業(yè)的經(jīng)濟效率的主要因素。顯而易見的是,國家和國際組織已經(jīng)發(fā)布了很多法律文件、國際公約和協(xié)議備忘錄以保護海員的權(quán)利。2006年,國際勞工組織(ILO)通過了一個包含現(xiàn)行68個國際海事公約和建議書所有最新標準以及其他國際勞工公約的基本原則的公約一一《2006海事勞工公約》(MLC2006). MLC 2006是規(guī)定確保海員穩(wěn)定工作的最低國際標準的公約;同時,它有助于所有已批準該公約的船旗國創(chuàng)建公平的競爭平臺。在這種情況下,該公約還通過確保效率和在海運中提高可靠性來促進競爭。本文將深入分析越南和中國通過在海員勞動合同、海員社會保障以及海員糾紛解決等方式來保護海員權(quán)利的相關(guān)法律。除了根據(jù)目前中國和越南的法律制度現(xiàn)狀來分析對海員權(quán)利的保護,本文還將結(jié)合其他國家相關(guān)經(jīng)驗來針對如何改善越南、中國法律制度提出一些建議。具體而言,本文共分以下幾部分內(nèi)容,第一章首先對選擇該題目的原因加以介紹,并對幾個主要國家的海員勞動權(quán)利保護方面的立法情況以及越南學(xué)者在海員勞動權(quán)利保護方面的研究情況進行簡要分析,接下來對研究的目的和任務(wù)進行分析,最后對方法論、本文的科研成果加以介紹;第二章圍繞海員勞動權(quán)利保護展開相關(guān)概念理論方面的探究,分別對海員權(quán)利的理論要點,海員的概念以及職業(yè)特點加以闡釋船員的基本權(quán)利,除了說明船員權(quán)利與其他權(quán)利的關(guān)系外,還說明了船員權(quán)利的范圍,提到了MLC 2006下的很多權(quán)利,界定本文研究的海員權(quán)利限于海員勞動合同權(quán)利、社會保障權(quán)利、勞動爭議解決的權(quán)利;第三章主要圍繞海員簽訂勞動合同的權(quán)利,一方面對海員勞動合同達成的相關(guān)權(quán)利加以介紹,另一方面對中越相關(guān)法律的優(yōu)缺點加以比較;第四章是有關(guān)海員受社會保障保護的權(quán)利,一方面對相關(guān)法律加以分析,另一方面還對越南法與中國法現(xiàn)行有關(guān)海員社會保險方面的權(quán)利加以分析;第五章海員在出現(xiàn)勞動糾紛時所享有的權(quán)利,分別對海事勞動糾紛中海員所享有的船舶優(yōu)先權(quán)加以論述;第六章對完善越南法下的海員勞動權(quán)利指令和解決方案加以分析;第七章對完善中國法下的海員勞動權(quán)利指令和解決方案加以分析;最后在第八章得出完善越南法與中國法的相應(yīng)結(jié)論。
[Abstract]:The most important labour force in the shipping industry is the crew of seafarers working on ships. This is an important and indispensable factor, and it is also the main factor that directly affects the economic efficiency of shipping enterprises and even the whole marine industry. It is clear that many legal documents, international conventions and memorandums of agreement have been issued by States and international organizations to protect the rights of seafarers. The International Labour Organization (ILO) has adopted a convention containing all the latest standards of 68 existing international maritime conventions and recommendations and the basic principles of other international labour conventions (MLC2006). MLC 2006 is the minimum international standard for ensuring the stability of seafarers; at the same time, it helps all flag States that have ratified the Convention to create a level playing field. In such cases, the Convention also promotes competition by ensuring efficiency and increased reliability in maritime transport. This paper will deeply analyze the relevant laws in Vietnam and China that protect seafarers' rights by means of seafarers' labor contracts, seafarers' social security and seafarers' dispute resolution. In addition to analyzing the protection of seafarers' rights according to the current situation of legal system in China and Vietnam, this paper will also put forward some suggestions on how to improve Vietnam's legal system by combining the relevant experiences of other countries. Specifically, this paper is divided into the following parts. The first chapter introduces the reasons for choosing this topic. It also briefly analyzes the legislation on the protection of seafarers' labour rights in several major countries and the research situation of Vietnamese scholars on the protection of seafarers' labour rights. Then, it analyzes the purpose and task of the research, and finally, the methodology. The second chapter focuses on the theory of seafarers' labor rights protection, and explains the basic rights of seafarers, including the theoretical points of seafarers' rights, the concept of seafarers and their professional characteristics. In addition to explaining the relationship between crew rights and other rights, it also explains the scope of crew rights, refers to many rights under MLC 2006, and defines the rights of seafarers studied in this paper as limited to seafarers' rights under labor contract and social security. The third chapter mainly focuses on the right of seafarers to sign labor contracts, on the one hand, introduces the relevant rights of seafarers' labor contracts, on the other hand, compares the advantages and disadvantages of the relevant laws between China and Vietnam; The fourth chapter is about the right of seafarers to be protected by social security. On the one hand, it analyzes the relevant laws, on the other hand, it also analyzes the existing rights of Vietnamese law and Chinese law on seafarers' social insurance. The fifth chapter discusses the maritime disputes' maritime liens respectively, and the sixth chapter analyzes the consummation of the Vietnamese law's directive and solution of the seafarers' labor rights. The seventh chapter analyzes the instructions and solutions to improve the labor rights of seafarers under Chinese law. Finally, in the eighth chapter, the author draws the corresponding conclusions of perfecting Vietnamese law and Chinese law.
