當(dāng)前農(nóng)民工養(yǎng)老保險(xiǎn)關(guān)系轉(zhuǎn)續(xù)遇到的主要問題研究

【摘要】:長期以來,由于農(nóng)民工身份特殊,逐漸演變?yōu)槌鞘械倪吘壢后w,其合法權(quán)益得不到保護(hù),特別是其社會(huì)保障難以進(jìn)入城市保障體系,同時(shí)其務(wù)工又務(wù)農(nóng)的特定身份也徘徊在農(nóng)村社保體系之外。如果沒有一個(gè)比較合理的社會(huì)保障制度,勢必導(dǎo)致以下兩種結(jié)果:一是由于各地區(qū)農(nóng)民工養(yǎng)老保險(xiǎn)政策不同,在關(guān)系轉(zhuǎn)移接續(xù)過程中,其養(yǎng)老權(quán)益不斷受到侵害。二是如果政府在社會(huì)保險(xiǎn)養(yǎng)老體制上改革不力、應(yīng)急不當(dāng)、處置不善,在人口回遷高峰、老齡化危機(jī)期,可能引發(fā)轉(zhuǎn)入地財(cái)務(wù)風(fēng)險(xiǎn),帶來政府的信用危機(jī)。20世紀(jì)90年代以來,全國各地特別是沿海發(fā)達(dá)城市對農(nóng)民工養(yǎng)老保險(xiǎn)制度進(jìn)行了探索,起到了穩(wěn)定隊(duì)伍、服務(wù)產(chǎn)業(yè)、平衡收支的作用。隨著我國養(yǎng)老保險(xiǎn)制度的完善,2010年、2014年國家先后出臺(tái)實(shí)施了《城鎮(zhèn)企業(yè)職工基本養(yǎng)老保險(xiǎn)關(guān)系轉(zhuǎn)移接續(xù)暫行辦法》和《城鄉(xiāng)養(yǎng)老保險(xiǎn)制度銜接暫行辦法》,為參保人員的養(yǎng)老保險(xiǎn)關(guān)系轉(zhuǎn)移提供了政策依據(jù),但在農(nóng)民工養(yǎng)老保險(xiǎn)關(guān)系轉(zhuǎn)移接續(xù)過程中,因機(jī)制體制、制度設(shè)計(jì)、服務(wù)水平、技術(shù)操作等因素,關(guān)系轉(zhuǎn)移接續(xù)問題始終沒有很好解決,引起了社會(huì)各界的高度、持續(xù)關(guān)注。本論文由五大部分構(gòu)成,其目的旨在引起社會(huì)關(guān)注、推進(jìn)我國農(nóng)民工養(yǎng)老保險(xiǎn)制度改革。第一章為緒論,簡述該選題背景和研究價(jià)值;回顧現(xiàn)有的國內(nèi)外文獻(xiàn),形成課題的綜括性認(rèn)識(shí)并總結(jié)學(xué)者們的研究傾向;概括本文的研究步驟、程序和研究手法,點(diǎn)出本文的創(chuàng)新和不足。第二章在介紹有關(guān)概念后,分步敘述我國農(nóng)民工養(yǎng)老保險(xiǎn)制度的變革,羅列出歷史中的四種典型模式并對他們進(jìn)行比較評(píng)析,找出這些探索與國務(wù)院后來出臺(tái)的有關(guān)政策之間的關(guān)系。第三章剖析、反思兩個(gè)《暫行辦法》制度本身。選取湖北省陽新縣為基點(diǎn)進(jìn)行問卷調(diào)查,以案例分析的方式闡述農(nóng)民工養(yǎng)老保險(xiǎn)關(guān)系轉(zhuǎn)接的現(xiàn)狀,進(jìn)而就制度在當(dāng)?shù)氐牟贿m應(yīng)表現(xiàn)提出所存在的問題。第四章經(jīng)過參閱有關(guān)資料和全盤考慮,探析產(chǎn)生問題的根源和相關(guān)制約性因素,主要與國家的政策體系問題和相關(guān)主體的責(zé)任界限不清有關(guān)聯(lián)。第五章結(jié)合歐盟流動(dòng)人口養(yǎng)老保險(xiǎn)關(guān)系對接的做法,就當(dāng)前我國農(nóng)民工養(yǎng)老保險(xiǎn)關(guān)系轉(zhuǎn)移接續(xù)實(shí)際情況,結(jié)合上述的的分析研究,對農(nóng)民工養(yǎng)老保險(xiǎn)關(guān)系轉(zhuǎn)移接續(xù)中不順暢的問題,提出了解決問題的辦法。
[Abstract]:For a long time, due to the special status of migrant workers, they have gradually evolved into the marginal groups of the city, and their legitimate rights and interests have not been protected, especially their social security is difficult to enter the urban security system. At the same time, its labor and agricultural identity hovering outside the rural social security system. If there is not a more reasonable social security system, it will inevitably lead to the following two results: first, due to the different policies of pension insurance for migrant workers in different regions, their pension rights and interests are constantly infringed in the process of relationship transfer. Second, if the government fails to reform the social insurance pension system, improperly, and mishandled, during the peak of population migration and the aging crisis, it may lead to financial risks in the local areas and bring about the credit crisis of the government since the 1990s. The old-age insurance system for migrant workers has been explored throughout the country, especially in developed coastal cities, which has played a role in stabilizing the ranks, serving the industry and balancing income and expenditure. With the perfection of the old-age insurance system in our country, in 2010, in 2014, the government successively promulgated and implemented the interim measures on the transfer of basic Endowment Insurance for employees in Urban and Rural Enterprises and the interim measures on the Convergence of Urban and Rural Old-age Insurance system. The transfer of the pension insurance relationship of personnel provides the policy basis. However, in the process of the relationship transfer of peasant workers' endowment insurance, due to the factors such as mechanism system, system design, service level, technology operation and so on, the problem of relationship transfer has not been solved well, which has aroused the attention of all walks of life. This paper is composed of five parts, the purpose of which is to arouse social concern and promote the reform of the old-age insurance system for migrant workers in China. The first chapter is the introduction, briefly describes the background and research value of this topic; reviews the existing domestic and foreign literature, forms a comprehensive understanding of the topic and summarizes the research tendency of scholars; summarizes the research steps, procedures and research techniques of this paper. This paper points out the innovation and deficiency. The second chapter, after introducing the relevant concepts, describes the reform of the old-age insurance system for migrant workers in China step by step, lists four typical models in history and makes a comparative analysis of them. Find out the relationship between these explorations and the relevant policies later issued by the State Council. The third chapter analyzes the two interim measures and reflects on the system itself. Taking Yangxin County of Hubei Province as the basic point of the questionnaire, this paper expounds the current situation of rural migrant workers' old-age insurance relationship transfer by case analysis, and then puts forward the existing problems of the system's inadaptability in the local areas. The fourth chapter, after referring to the relevant information and overall consideration, analyzes the root causes of the problems and related restrictive factors, which are mainly related to the problems of the national policy system and the unclear boundaries of the responsibilities of the relevant subjects. The fifth chapter combined with the European Union floating population pension insurance relationship docking practice, according to the current situation of migrant workers pension insurance relationship transfer, combined with the above analysis and research, This paper puts forward some solutions to the problem of the unsmooth transfer of the relationship between migrant workers and pension insurance.
