【摘要】：為了公共利益的需要國(guó)家可依法征收土地并給予補(bǔ)償,但我國(guó)土地增值收益分配中所存在的非"包容性"行為必然導(dǎo)致土地利益分配不合理,針對(duì)土地征收補(bǔ)償標(biāo)準(zhǔn)的研究已成為解決民生問題、維護(hù)社會(huì)穩(wěn)定的重要課題。目前,我國(guó)以土地"原用途"為基礎(chǔ)、以土地"年產(chǎn)值"倍數(shù)法為基礎(chǔ)以及以土地"市場(chǎng)價(jià)值"為基礎(chǔ)的三種征地補(bǔ)償標(biāo)準(zhǔn),都不能同時(shí)涵蓋土地的經(jīng)濟(jì)價(jià)值、社會(huì)保障價(jià)值以及生態(tài)價(jià)值,綜合補(bǔ)償標(biāo)準(zhǔn)能夠在一定程度上解決上述三種補(bǔ)償標(biāo)準(zhǔn)的缺陷。土地綜合補(bǔ)償標(biāo)準(zhǔn)由于其考慮補(bǔ)償因素的全面性,對(duì)于失地農(nóng)民來說具有一定的公平性,達(dá)到了效率和公平的相對(duì)均衡。
[Abstract]:In order to meet the needs of public interest, the state can expropriate land according to law and give compensation. However, the non-inclusive behavior in the distribution of land value-added benefits in China will inevitably lead to unreasonable distribution of land interests. The research on compensation standard of land expropriation has become an important issue to solve livelihood problems and maintain social stability. At present, three kinds of land requisition compensation standards, which are based on land "original use", land "annual output value" multiple method and land "market value", can not cover the economic value of land at the same time. The social security value and the ecological value, the comprehensive compensation standard can solve the defects of the above three kinds of compensation standards to a certain extent. Because of the comprehensive consideration of the compensation factors, the comprehensive land compensation standard has a certain fairness for the land-losing farmers, and achieves the relative equilibrium of efficiency and fairness.
