【摘要】：保障人民的居住權利,是憲法對于基本人權保護的基本要求之一。我國的人口基數(shù)大,對住房的需求始終存在巨大壓力。隨著我國城鎮(zhèn)化進程的不斷深入,城市中低收入人群數(shù)量不斷增長,滿足人民居住需求的難度也在持續(xù)增加。保障人民適足住房權,實現(xiàn)社會公平公正,成為我國亟待解決的問題。近年來,我國開始重視保障性住房的建設,保障性安居工程建設已成為我國建設規(guī)劃綱要的一項重要內(nèi)容,旨在緩解人們對住房需求的壓力。作為保障性住房制度中最重要的一個內(nèi)容,保障性住房供給制度決定了我國住房保障能否取得成效。發(fā)展完善保障性住房供給制度,可以推動住房權入憲進程,從而可以早日實現(xiàn)對人民的適足住房權的憲法保護;可以在制度實施上使我國的住房保障得到持續(xù)高效發(fā)展,推動公平正義的社會保障事業(yè)的完善。目前我國的保障性住房供給制度存在著經(jīng)濟適用房制度、廉租房制度、公租房制度、限價商品房制度以及住房公積金制度等供給模式。由于我國相關立法的不健全,在保障性住房供給制度中存在著許多問題,諸如缺乏對公民適足住房權的憲法保護;對保障性住房供給對象的判定標準、審查標準和供給模式缺乏法律規(guī)制;對政府在保障性住房供給制度中所應承擔的責任和履行職能的方式?jīng)]有立法限制;對其他配套的制度,如資金支持的制度設計、住房保障用地的供應制度、保障性住房建設的規(guī)劃、房屋質(zhì)量的標準與審查,以及對內(nèi)對外的監(jiān)督制度,都缺乏法律規(guī)定的標準。這些都不利于我國住房保障公共事業(yè)的發(fā)展。對此,本文通過對存在問題根源的分析,以及對國外發(fā)達國家保障性住房供給制度相關的經(jīng)驗,提出了對存在問題的解決途徑。要建立健全保障性住房供給法律體系,盡快實現(xiàn)“住房權”入憲,并從保障對象的確立和供給方式的確定兩個主要內(nèi)容入手加速出臺《住房保障法》。要完善政府在保障性住房供給制度中的角色,明確與強化政府職能,設立專門性主管機構(gòu)來統(tǒng)籌管理保障性住房供給體系的運行。要健全配套制度建設,完善資金支持,包括完善政府財政支持、完善住房公積金制度和拓寬融資渠道;完善土地供應制度,豐富《土地管理法》對保障性住房供給制度的相關內(nèi)容;完善住房規(guī)劃與住房質(zhì)量的相關制度。要從內(nèi)部監(jiān)督與外部社會監(jiān)督兩個方面入手完善監(jiān)督機制。
[Abstract]:The protection of the people's right of residence is one of the basic requirements of the Constitution for the protection of basic human rights. The population base of our country is big, the demand for housing always exists huge pressure. With the development of urbanization in China, the number of middle and low income people in cities is increasing, and the difficulty of meeting the living needs of the people is also increasing. To protect people's right to adequate housing and to realize social justice has become an urgent problem in our country. In recent years, our country has begun to attach importance to the construction of affordable housing, and the construction of affordable housing has become an important part of our country's construction planning program, in order to alleviate the pressure on people's housing demand. As one of the most important contents of the indemnificatory housing system, the supportable housing supply system determines the effectiveness of the housing security in our country. Developing and perfecting the system of providing affordable housing can promote the process of housing right into the constitution, so as to realize the constitutional protection of people's right to adequate housing as soon as possible, and enable the sustainable and efficient development of housing security in our country in the implementation of the system. To promote the perfection of fair and just social security. At present, the supply system of affordable housing in China includes comfortable housing system, low-rent housing system, public rental housing system, limited price commercial housing system and housing provident fund system. Due to the imperfection of relevant legislation in China, there are many problems in the supply system of affordable housing, such as the lack of constitutional protection of citizens' right to adequate housing, the criterion of judging the object of supply of affordable housing, Lack of legal regulation on review standards and supply modes; no legislative restrictions on the responsibilities and ways of performing functions of the government in the supply system of affordable housing; and design of other supporting systems, such as financial support system, The supply system of housing security land, the planning of housing construction, the standard and examination of housing quality, and the supervision system of internal and external, all lack the standards stipulated by law. These are not conducive to the development of public housing security in China. In this paper, through the analysis of the root causes of the existing problems, as well as the relevant experience of the developed countries in the supply system of affordable housing, this paper puts forward the solutions to the existing problems. It is necessary to establish and perfect the legal system of the supply of affordable housing, realize the entry of the "right of housing" into the Constitution as soon as possible, and accelerate the introduction of the Housing Security Law from the two main contents: the establishment of the object of security and the determination of the mode of supply. It is necessary to perfect the role of the government in the supply system of affordable housing, clarify and strengthen the functions of the government, and set up specialized competent agencies to manage the operation of the supply system of indemnificatory housing as a whole. It is necessary to improve the construction of supporting systems, perfect the financial support of the government, perfect the housing accumulation fund system and broaden the financing channels, and perfect the land supply system. It enriches the relevant contents of the land management law on the supply system of affordable housing, and consummates the relevant system of housing planning and housing quality. We should improve the supervision mechanism from two aspects: internal supervision and external social supervision.
