【摘要】：對(duì)于社會(huì)保障制度從社會(huì)學(xué)、經(jīng)濟(jì)學(xué)、公共管理學(xué)等領(lǐng)域展開研究已經(jīng)具有顯見的成效，而從法學(xué)領(lǐng)域研究社會(huì)保障問題，在我國(guó)的歷史并不長(zhǎng)，其中從憲法意義上平等權(quán)的視角審視這一問題，在法學(xué)界則關(guān)注不多但卻極有必要。平等權(quán)與社會(huì)保障制度具有密切的理論關(guān)聯(lián)，平等權(quán)是社會(huì)保障制度形成的理論和基礎(chǔ)，，社會(huì)保障制度則是平等權(quán)的實(shí)現(xiàn)途徑。而作為社會(huì)保障制度中的各個(gè)分支部分，即社會(huì)保險(xiǎn)、社會(huì)福利、社會(huì)救濟(jì)、社會(huì)優(yōu)撫等，既是基于追求實(shí)質(zhì)平等觀這一前提而建立的諸具體制度，同時(shí)，通過各單行立法而建立起的各項(xiàng)制度又體現(xiàn)出對(duì)公民實(shí)質(zhì)意義上平等權(quán)的保障作用。我國(guó)的社會(huì)保障制度起步較晚，在實(shí)施中也存在著諸多問題，也直接影響到公民平等權(quán)的實(shí)現(xiàn)，只有通過完善相關(guān)立法、理順行政體系、細(xì)化司法救濟(jì)程序等，才能真正實(shí)現(xiàn)社會(huì)保障制度與公民平等權(quán)之間的互動(dòng)作用。
[Abstract]:The research on social security system from the fields of sociology, economics, public management and so on has already had remarkable results, but the history of studying social security from the legal field is not long in our country. To examine this issue from the perspective of constitutional equality, it is necessary to pay less attention to it in the field of law. The right to equality is closely related to the social security system, the right to equality is the theory and foundation of the formation of the social security system, and the social security system is the way to realize the right to equality. As a branch of the social security system, such as social insurance, social welfare, social relief, social benefit, etc., it is not only based on the pursuit of the concept of substantive equality of the establishment of the specific system, at the same time, The system established through the separate legislation also embodies the protection of citizens' right to equality in essence. The social security system of our country starts relatively late, also has many problems in the implementation, also directly affects the realization of the citizen equality right, only through perfecting the relevant legislation, straightening out the administrative system, refining the judicial relief procedure, etc. Only then can the interaction between the social security system and the equal rights of citizens be realized.
