【摘要】：城市化是社會經(jīng)濟發(fā)展的趨勢,近些年來,隨著我國城市化進程的加快,原有的城市土地已不能滿足城市化對土地的大量需求,城市向農(nóng)村借地成為必然趨勢,由此形成龐大的失地農(nóng)民群體。當前,由于我國法律規(guī)定以及制度上的一些缺陷,失地農(nóng)民在社會經(jīng)濟生活中的權(quán)益并未得到相應(yīng)的保護,導(dǎo)致各種沖突和群體性事件不斷,最終制約城市化進程及社會和諧。城市化是社會發(fā)展不可逆轉(zhuǎn)的趨勢,但最大限度的保護在城市化進程中犧牲自己權(quán)益的失地農(nóng)民卻是應(yīng)當和必須的。本文分五個部分對城市化進程中失地農(nóng)民權(quán)益的保護進行了研究。第一部分導(dǎo)論主要撰寫了本文的選題背景和研究意義、研究綜述以及本文的研究方法。第二部分主要對文章涉及的概念作出了界定,分析了城市化與失地農(nóng)民權(quán)益的關(guān)系。第三部分析了城市化進程中失地農(nóng)民權(quán)益缺失的表現(xiàn),主要分兩大部分,從物質(zhì)方面的權(quán)益和精神方面的權(quán)益進行探究。第四部分針對失地農(nóng)民權(quán)益缺失的現(xiàn)狀,從土地制度、征地制度、征地補償制度以及城鄉(xiāng)二元結(jié)構(gòu)幾個方面研究了失地農(nóng)民權(quán)益缺失的原因。第五部分主要從完善農(nóng)村土地產(chǎn)權(quán)法律制度、征地法律制度、征地補償法律制度以及社會保障法律制度幾個方面提出建議,進而更好的保障失地農(nóng)民的權(quán)益。
[Abstract]:Urbanization is the trend of social and economic development. In recent years, with the acceleration of urbanization in China, the original urban land can no longer meet the large demand of urbanization for land, so it is an inevitable trend for cities to borrow land from rural areas. As a result, the formation of a large group of landless farmers. At present, due to some defects in laws and regulations of our country, the rights and interests of landless peasants in social and economic life have not been protected accordingly, resulting in various conflicts and group events, which ultimately restrict the process of urbanization and social harmony. Urbanization is an irreversible trend of social development, but it is necessary and necessary to protect the land-losing peasants who sacrifice their rights and interests in the process of urbanization. This paper is divided into five parts to study the protection of the rights and interests of landless farmers in the process of urbanization. The first part mainly introduces the background and significance of this paper, the research review and the research methods of this paper. The second part mainly defines the concept involved in the article and analyzes the relationship between urbanization and the rights and interests of landless farmers. The third part analyzes the lack of rights and interests of land-lost farmers in the process of urbanization, mainly divided into two parts, from the material and spiritual aspects of the rights and interests to explore. In the fourth part, according to the current situation of the lack of land farmers' rights and interests, the paper studies the reasons of the loss of land farmers' rights and interests from the land system, the compensation system of land expropriation and the dual structure of urban and rural areas. The fifth part mainly puts forward some suggestions from the aspects of perfecting the legal system of rural land property right, land expropriation and compensation, and social security legal system, so as to better protect the rights and interests of landless farmers.
