【摘要】：人口老齡化的浪潮已經(jīng)遍布世界各地,除了中東的少部分地區(qū)和非洲以外,世界一半以上的國家和地區(qū)都在一樣的挑戰(zhàn)著人口老齡化引發(fā)的社會動湯趨勢和巨大風險壓力,伴隨一起的還有強大的社會經(jīng)濟重擔和政治方面的壓力,如何解決好人口快速老齡化這一世界性問題已經(jīng)成為每個國家和地區(qū)最為關心的時代難題。老齡化社會開始于20世紀,時至今日我們國家老齡人口數(shù)量有增無減,老齡人口的規(guī)模加速壯大,高齡老人、空巢老人和失能老人數(shù)量日漸增長的現(xiàn)狀尤為突出,對我國傳統(tǒng)養(yǎng)老體制和現(xiàn)在的老年人社會保障體制產(chǎn)生了巨大的沖擊。引人注意的是,由于城鄉(xiāng)二元經(jīng)濟結構等原因,導致農(nóng)村老齡化問題被人們所忽略,從而形成了我國獨具特色的老年人養(yǎng)老制度二元化格局。農(nóng)村老年人目前的生活現(xiàn)狀應該引起政府、社會和家庭的關注,這就需要加強法律制度建設,讓制度先行,為維護他們的權益提供強有力的保證,助推構建和諧社會的進程。本文將對農(nóng)村老年人在法律保護過程中出現(xiàn)的問題進行客觀分析,找出原因,另外借鑒參考其他國家在保護老年人權益中的一些好的經(jīng)驗和做法,在此基礎上,提出進一步完善我國農(nóng)村老年人在權益保護立法方面和在實踐中具有可操作性的建議。
[Abstract]:The tide of population aging has spread all over the world. With the exception of a few parts of the Middle East and Africa, more than half of the world's countries and regions are equally challenging the social trends and enormous risk pressures caused by population ageing. Accompanied by strong social and economic burdens and political pressure, how to solve the world problem of rapid aging of population has become the most concerned by every country and region. The aging society began in the 20th century. Today, the number of the elderly population in our country is increasing, and the size of the elderly population is growing rapidly. The increasing number of the elderly, the empty-nesters and the disabled are particularly prominent. It has a great impact on the traditional pension system and the current social security system for the elderly. Attention is drawn to the fact that due to the dual economic structure between urban and rural areas the problem of aging in rural areas has been neglected thus forming a dualistic pattern of the old-age pension system with its unique characteristics in our country. The current living situation of the elderly in rural areas should attract the attention of the government, society and family. It is necessary to strengthen the construction of the legal system, to give the system first, to provide a strong guarantee for the protection of their rights and interests, and to promote the process of building a harmonious society. This article will carry on the objective analysis to the countryside old person in the legal protection process question, finds out the reason, in addition draws lessons from other countries in the protection of the old people's rights and interests in some good experiences and practices, on this basis, Some suggestions are put forward to further improve the legislation and practice of rural elderly people's rights and interests protection.
