【摘要】: 勞動是每一個公民的權利和義務,就業(yè)權是公民的一項重要權利,殘疾人也有參加勞動的權利和義務,也享有就業(yè)權,國家同樣保障殘疾人的就業(yè)權利。殘疾人就業(yè)權,是指有就業(yè)資格的殘疾人,能夠獲得從事有報酬或收入的職業(yè)性勞動的權利,其包括平等就業(yè)和選擇職業(yè)的權利、獲得勞動報酬的權利、休息和休假的權利、獲得勞動安全保護的權利、接受職業(yè)技能培訓的權利、享受社會保險和福利的權利等。殘疾人就業(yè)既是其享有基本公民權利的標志,又是其實現(xiàn)人生價值的關鍵。保障殘疾人就業(yè)權是解決殘疾人就業(yè)問題的前提,也是殘疾人改善生活狀況、提高社會地位、參與社會生活的基礎。 殘疾人由于受生理或心理上的限制,在就業(yè)市場中處于弱勢地位,他們的就業(yè)權益往往難以得到實現(xiàn),隨著社會的進步、時代的發(fā)展,如何保障殘疾人的就業(yè)權,促進殘疾人就業(yè),已成為我國政府目前需要認真對待的一個問題。因此,殘疾人就業(yè)權的研究具有非常重要的理論和現(xiàn)實意義。 我國政府歷來重視殘疾人就業(yè)問題,新中國成立后,特別是十一屆三中全會以來,我國政府加大了殘疾人就業(yè)權法律保障制度的建設,至今已初步建立起了一個以憲法為核心的適應市場經(jīng)濟要求的,保障殘疾人勞動就業(yè)權的法律框架,使法律保障成為殘疾人就業(yè)權實現(xiàn)的最有效、最基本的手段。但由于該立法體系不完善,法律內(nèi)容滯后,強制力不足,使得殘疾人就業(yè)權的實現(xiàn)遭遇到了不少現(xiàn)實困難和阻力。 本文擬就殘疾人就業(yè)權這一問題做一探討,希望能使目前我國關于殘疾人就業(yè)方面的法律法規(guī)進一步完善,為在法律上保障殘疾人就業(yè)權實現(xiàn),促進殘疾人更好的就業(yè)起到一定的作用。本文分五個部分,本文第一部分對殘疾人就業(yè)權進行了屬性分析,指出殘疾人就業(yè)權是一項重要人權,是一項平等權,是一項社會扶助權。本文第二部分介紹了我國關于殘疾人就業(yè)立法的狀況,回顧了從古至今殘疾人就業(yè)立法的規(guī)定,著重介紹了新中國成立以后國家對殘疾人就業(yè)權的法律保障,并對殘疾人就業(yè)權的內(nèi)容作了詳細的界定,并介紹了法律關于殘疾人就業(yè)權實現(xiàn)的途徑。本文第三部分從殘疾人就業(yè)現(xiàn)狀、影響殘疾人就業(yè)權實現(xiàn)的不利因素對我國殘疾人就業(yè)權進行了現(xiàn)狀考察,指出了殘疾人就業(yè)權實現(xiàn)方面的問題。本文第四部分介紹了國際上其他國家對殘疾人就業(yè)權的法律保護概況。本文第五部分從完善殘疾人就業(yè)權的立法保障體系、執(zhí)法保障體系、司法救濟體系、法律援助制度四個方面提出了完善我國殘疾人就業(yè)權法律保障制度的措施。
[Abstract]:Labor is the right and duty of every citizen, the right to employment is an important right of citizens, the disabled also have the right and obligation to participate in labor, and also enjoy the right of employment. The state also guarantees the employment right of the disabled. The right to employment of persons with disabilities refers to the right of persons with disabilities with employment qualifications to engage in gainful or gainful occupational work, including the right to equal employment and choice of occupation, the right to remuneration for work, the right to rest and leave, The right to work safety protection, the right to vocational skills training, the right to social security and benefits, etc. Employment of disabled persons is not only the symbol of their basic civil rights, but also the key to realize their life value. The guarantee of the disabled's right to employment is the premise to solve the employment problem of the disabled, and also the basis for the disabled to improve their living conditions, improve their social status and participate in the social life. The disabled are in a weak position in the job market because of their physical or psychological restrictions, and their employment rights and interests are often difficult to realize. With the progress of society and the development of the times, how to protect the employment rights of the disabled, To promote the employment of the disabled has become a serious problem that our government needs to take seriously at present. Therefore, the study of disabled employment right has very important theoretical and practical significance. Our government has always attached importance to the employment of persons with disabilities. After the founding of New China, especially since the third Plenary session of the Eleventh Central Committee, the Chinese government has stepped up the construction of a legal protection system for the employment rights of persons with disabilities. Up to now, a constitution-centered legal framework to protect the disabled's right to work has been established, which is the most effective and basic means to realize the disabled's right to employment. However, because the legislation system is not perfect, the content of the law lags behind and the force is insufficient, the realization of the disabled's right to employment has encountered many practical difficulties and resistance. This paper intends to discuss the employment right of the disabled, hoping to further improve the current laws and regulations on the employment of the disabled, in order to guarantee the realization of the employment right of the disabled in law. Promoting better employment for the disabled will play a certain role. This paper is divided into five parts. The first part of this paper analyzes the employment right of the disabled, and points out that the employment right of the disabled is an important human right, a right of equality and a right of social assistance. The second part of this paper introduces the status of employment legislation for the disabled in China, reviews the provisions of the employment legislation for the disabled from ancient times to the present, and focuses on the legal protection of the employment rights of the disabled after the founding of the people's Republic of China. The content of the employment right of the disabled is defined in detail, and the ways of realizing the employment right of the disabled are introduced. In the third part of this paper, the present situation of disabled persons' employment right and the unfavorable factors affecting the realization of the disabled's employment right are investigated, and the problems in the realization of the disabled's employment right are pointed out. The fourth part of this paper introduces the legal protection of disabled people's right to employment in other countries. The fifth part of this paper puts forward the measures to perfect the legal safeguard system of the employment right of the disabled in our country from four aspects: the legislative guarantee system, the law enforcement guarantee system, the judicial relief system and the legal aid system.
