【摘要】：以危險方法危害公共安全罪在對社會風險事件給予重擊的同時,罪刑法定原則的明確性也因刑事政策的寬泛解讀、司法受制于社會輿論而遭受沖擊。公共的本質(zhì)在于社會性,而社會性是個體性抽象化、一般化的集合,多數(shù)只是公共的外在表現(xiàn)形式,只是從數(shù)量上對公共的直觀描述�！安惶囟ǘ鄶�(shù)”的限定關系最準確概括了“公共”的本質(zhì),即個體利益的抽象化的集合。司法適用中對本罪“其他”的理解過于隨意,容易導致司法適用的不統(tǒng)一,引發(fā)理解上的混亂,同時破壞罪刑法定原則的確定性。刑法的謙抑性和罪刑法定原則要求對本罪進行必要限制。對于“其他”的認定應當是對獨立于刑法第114條中明確列舉的行為之外的同等類型性的行為進行兜底,不能作為刑法分則第二章危害公共安全罪中的具體罪名的兜底,也不能理解為整個刑法分則的兜底。同時,“其他”的內(nèi)涵隨著立法的進步而不斷限縮,這也是罪刑法定原則明確性的要求。要解決危險方法立法上的空白描述的不足,既要揭示危險方法的定性要素與定量要素統(tǒng)一,又應當認清危險方法的內(nèi)在屬性和外在特征。改變本罪立法上的模糊,實現(xiàn)抽象立法的具體化是關鍵。司法實踐應當重視司法案例的指導作用,必須建立一套完整的司法案例指導機制,才能充分發(fā)揮以危險方法危害公共安全罪在應對必要不得已的社會風險方面社會保障功效。
[Abstract]:At the same time, the crime of endangering public security by dangerous methods gives a heavy blow to social risk events. The clarity of the principle of legality is also influenced by the broad interpretation of criminal policy and the impact of the judicial system on social public opinion. The nature of the public is sociality, and the sociality is individualized, a general collection, and most of the public outside. In the form of expression, it is only a visual description of the public from quantity. The definition of "no specific majority" is the most accurate summary of the essence of "public", that is, the abstract collection of individual interests. In judicial application, the understanding of the "other" of the crime is too arbitrary, which easily leads to the disunity of judicial application and causes confusion in understanding. The certainty of the principle of sabotaging the legality of crime and punishment. The modesty of the criminal law and the principle of legality require the necessary restrictions on the crime. The affirmation of the "other" should be the bottom of the same type of behavior, which is independent of the explicit act listed in the 114th article of the criminal law, and can not be used as the second chapter of the criminal law for the crime of endangering public security. The bottom of the specific crime can not be understood as the bottom of the whole criminal law. At the same time, the connotation of the "other" is limited by the progress of the legislation, which is also the requirement of the clear principle of the principle of legal punishment. To solve the deficiency of the blank description in the legislation of the dangerous method, we should not only reveal the qualitative elements and the quantitative elements of the dangerous methods. First, we should recognize the inherent and external characteristics of the dangerous methods. It is the key to change the ambiguity in the legislation of the crime and realize the concretion of the abstract legislation. The judicial practice should attach importance to the guiding role of the judicial cases, and must establish a complete set of judicial case guidance mechanism to give full play to the crime of endangering public safety by dangerous methods. The social security effect of the necessary social risks.
