【摘要】：兩岸青年學(xué)生往來(lái)關(guān)系到兩岸關(guān)系發(fā)展的未來(lái),處理好相關(guān)法律問(wèn)題,維護(hù)好兩岸學(xué)生的基本權(quán)益,有利于兩岸關(guān)系的深化與鞏固。通過(guò)對(duì)兩岸交換生群體的現(xiàn)狀調(diào)研發(fā)現(xiàn)兩岸在獎(jiǎng)學(xué)金、學(xué)分采認(rèn)、社會(huì)保障、就業(yè)與兼職等方面的法律法規(guī)存在差異性,表現(xiàn)出臺(tái)灣法規(guī)的歧視性和大陸立法的不完善性等問(wèn)題。一方面,應(yīng)以兩岸協(xié)議的方式化解修法難題,在此基礎(chǔ)上促進(jìn)臺(tái)灣修法,即從基本人權(quán)的角度注重保護(hù)大陸赴臺(tái)學(xué)生教育權(quán)、健康權(quán)和生存權(quán);同時(shí),促進(jìn)大陸涉臺(tái)立法在位階上和可操作性上的全面完善。另一方面,應(yīng)加強(qiáng)對(duì)高校管理人員涉臺(tái)立法的培訓(xùn)及在臺(tái)生入學(xué)環(huán)節(jié)的宣傳,設(shè)置涉臺(tái)生法律法規(guī)網(wǎng)上查詢?nèi)肟?發(fā)揮涉臺(tái)社團(tuán)組織服務(wù)臺(tái)生的作用。
[Abstract]:The exchange of young students on both sides of the strait is of great importance to the future of the development of cross-strait relations. It is beneficial to deepen and consolidate cross-strait relations by properly handling relevant legal issues and safeguarding the basic rights and interests of students on both sides of the strait. By investigating the current situation of cross-Strait exchange students, we find that there are differences in the laws and regulations between the two sides in terms of scholarship, credit recognition, social security, employment and part-time work. It shows that Taiwan's laws and regulations are discriminatory and the mainland's legislation is not perfect. On the one hand, it is necessary to resolve the problem of amending the law by means of cross-strait agreements, and on this basis, to promote the revision of the law in Taiwan, that is, from the perspective of basic human rights, to pay attention to the protection of the right to education, health and survival of mainland students in Taiwan; at the same time, To promote the Taiwan-related legislation in the mainland in the rank and maneuverability of the overall improvement. On the other hand, it is necessary to strengthen the training of the administrative personnel in colleges and universities and the propaganda of the admission link of the students, to set up the entrance of the laws and regulations of the students involved in Taiwan on the Internet, and to give play to the role of helping desk students organized by the associations involved in Taiwan.
