【摘要】：工傷保險待遇先行支付制度是我國社會保險基金先行支付體系的重要組成部分,也是我國社會救助體系必不可少的手段和途徑。它凸顯了工傷保險的社會救濟(jì)和社會保障的功能與價值,彰顯了社會公平與正義。但由于制度設(shè)計的缺陷和客觀環(huán)境等因素的影響,我國的工傷保險待遇先行支付制度在實施過程中出現(xiàn)了不少問題,故而,必須通過完善該制度以更好地實現(xiàn)其社會價值。本文圍繞工傷保險待遇先行支付制度實踐這一主題,分以下五個部分展開討論:第一部分為本文的引言。主要介紹了選題背景、文獻(xiàn)綜述、研究方法以及本文的創(chuàng)新之處。第二部分主要從理論層面對我國的工傷保險待遇先行支付制度進(jìn)行闡釋。該部分首先介紹了工傷保險待遇先行支付及與其相關(guān)概念,并分別從理論和法條規(guī)范兩個層面對工傷保險待遇先行支付的類型進(jìn)行分析,進(jìn)而就有關(guān)先行支付的理論學(xué)說進(jìn)行梳理,并在此基礎(chǔ)上,對工傷保險待遇先行支付制度的價值與意義進(jìn)行了探討。第三部分對我國工傷保險待遇先行支付制度的現(xiàn)狀進(jìn)行考察。該部分主要從規(guī)范現(xiàn)狀和實施現(xiàn)狀兩個方面展開討論,其中,規(guī)范現(xiàn)狀主要考察我國工傷保險待遇先行支付制度的現(xiàn)行規(guī)范體系及相關(guān)具體內(nèi)容;而實施現(xiàn)狀主要考察先行支付申請、先行支付行政訴訟及勞動者對該制度的認(rèn)知等方面的現(xiàn)狀。第四部分主要對我國工傷保險待遇先行支付制度實施環(huán)節(jié)存在的問題進(jìn)行深入分析。該部分通過工傷保險待遇先行支付申請和行政訴訟兩個方面進(jìn)行闡釋,其實踐中存在的主要問題表現(xiàn)在:一次性先行支付的濫用、社保經(jīng)辦機(jī)構(gòu)認(rèn)定用人單位“不支付”證明材料過于狹窄、先行支付缺乏監(jiān)督等。最后一部分主要對完善我國工傷保險待遇先行支付制度的對策進(jìn)行探討。該部分主要從保障勞動者及時獲得工傷保險待遇的實際需要出發(fā),針對實踐中存在的具體問題,從工傷保險待遇先行支付制度的申請審核和行政訴訟兩個方面提出完善我國工傷保險待遇先行支付制度的對策建議。
[Abstract]:The advance payment system of industrial injury insurance is an important part of the advance payment system of social insurance fund in our country, and it is also an indispensable means and means of social assistance system in our country. It highlights the function and value of social relief and social security of industrial injury insurance, as well as social fairness and justice. However, due to the defects of the system design and the influence of the objective environment, there are many problems in the implementation of the advance payment system of industrial injury insurance in our country. Therefore, it is necessary to improve the system to realize its social value better. This paper focuses on the theme of industrial injury insurance advance payment system, divided into the following five parts: the first part is the introduction of this paper. This paper mainly introduces the background, literature review, research methods and innovation of this paper. The second part mainly explains the advance payment system of industrial injury insurance in China from the theoretical level. This part first introduces the advance payment of industrial injury insurance and its related concepts, and analyzes the types of advance payment of industrial injury insurance from the two aspects of theory and regulation. On the basis of this, the paper discusses the value and significance of the advance payment system of industrial injury insurance. The third part investigates the current situation of the advance payment system of industrial injury insurance in China. This part mainly discusses from two aspects: the current situation of regulation and the current situation of implementation, among which, the current standard system and related specific contents of the system of advance payment of the treatment of industrial injury insurance in China are mainly investigated. The present situation of the implementation mainly includes the application for advance payment, the administrative litigation and the cognition of the laborer to the system. The fourth part mainly analyzes the problems existing in the implementation of the advance payment system of industrial injury insurance in China. This part is explained in two aspects: the application for advance payment of industrial injury insurance treatment and the administrative litigation. The main problems in practice are: the abuse of one-off advance payment, Social security agencies that employers "do not pay" proof material is too narrow, payment in advance lack of supervision. In the last part, the countermeasures to perfect the advance payment system of industrial injury insurance in China are discussed. This part mainly starts from the actual need of ensuring workers get the industrial injury insurance treatment in time, aiming at the concrete problems existing in practice, This paper puts forward the countermeasures and suggestions to perfect the advance payment system of industrial injury insurance in China from two aspects: the application examination of the advance payment system of industrial injury insurance treatment and the administrative litigation.
