我國(guó)廉租房法律制度研究

【摘要】:衣食住行,自古以來(lái)就是人們正常生產(chǎn)生活必不可少的要素,住宅權(quán)已經(jīng)在世界范圍內(nèi)被公認(rèn)為人類的基本人權(quán),世界范圍內(nèi)的多數(shù)國(guó)家通過(guò)立法保障公民的這項(xiàng)基本人權(quán),F(xiàn)階段,我國(guó)正致力于不斷完善社會(huì)保障制度,而住房保障制度有其重要的位置。廉租房保障制度面對(duì)廣大低收入家庭的住房困難群體是住房保障制度的重要內(nèi)容。自1998年我國(guó)提出廉租房制度這一概念至今,廉租房制度已經(jīng)經(jīng)歷了十多年的建設(shè)和發(fā)展,雖然在這十年中我們對(duì)廉租房制度取得了一定的成績(jī),解決了全國(guó)范圍內(nèi)的一部分低收入住房困難群體的住房問(wèn)題,但是在實(shí)踐中和法制中仍然存在諸多問(wèn)題。 目前,廉租房制度的研究主要涉及的領(lǐng)域即社會(huì)學(xué)、行政管理學(xué)、經(jīng)濟(jì)學(xué)等層面,從法學(xué)的角度來(lái)看,現(xiàn)階段規(guī)定廉租房建設(shè)還沒有法律的規(guī)定,只有幾個(gè)部門規(guī)章支撐著整個(gè)建設(shè)和管理廉租房制度的大廈。因此,廉租房保障制度并未形成完整的法律體系和相關(guān)的配套措施。鑒于此,剖析廉租房建設(shè)在實(shí)踐中可能遇到的法律問(wèn)題,在這基礎(chǔ)上歸類整合制定《住房保障法》,這對(duì)于構(gòu)建我國(guó)的廉租房法律制度有著較為深遠(yuǎn)的理論意義和現(xiàn)實(shí)意義。 本文共分為五個(gè)部分,第一部分是導(dǎo)言部分,其中介紹了研究廉租房法律制度的背景和意義、論述了國(guó)內(nèi)外的研究現(xiàn)狀以及提出了本文寫作的方法及創(chuàng)新點(diǎn)。第二部分是對(duì)廉租房制度的基本理論及法理基礎(chǔ)的概述,分別對(duì)廉租房制度的概念及辨析、廉租房制度的特征、廉租房制度的緣起和發(fā)展、廉租房制度的法理基礎(chǔ)等基本問(wèn)題進(jìn)行闡述。第三部分是發(fā)達(dá)國(guó)家(或地區(qū))的廉租房制度的比較,分別介紹了美國(guó)、新加坡、中國(guó)香港地區(qū)有關(guān)建設(shè)發(fā)展廉租房制度的成功經(jīng)驗(yàn)。第四部分深度分析我國(guó)廉租房法律制度的問(wèn)題:立法層級(jí)偏低、保障對(duì)象的范圍偏窄、建設(shè)資金短缺,房源供應(yīng)有限、政府土地供應(yīng)不足、有關(guān)廉租房的準(zhǔn)入退出機(jī)制、監(jiān)督管理、法律懲戒機(jī)制仍不健全等相關(guān)法律問(wèn)題。第五部分是本文的重點(diǎn),筆者提出構(gòu)建我國(guó)廉租房法律制度的具體構(gòu)想:提高廉租房法律制度的立法層級(jí)、保障對(duì)象內(nèi)部建立多層次階梯式的保障結(jié)構(gòu)、確保廉租房建設(shè)的資金和補(bǔ)貼來(lái)源、規(guī)范廉租房申請(qǐng)人和廉租戶的權(quán)利和義務(wù)、建立科學(xué)的廉租房法律制度相關(guān)配套機(jī)制,其中包括建立科學(xué)的準(zhǔn)入實(shí)體標(biāo)準(zhǔn)、建立完善的退出銜接制度、建立分層次的法律懲戒制度等。
[Abstract]:Since ancient times, food, clothing, housing and transportation are essential elements of people's normal production and life. The right to housing has been recognized as the basic human rights of human beings in the world, and most countries in the world have adopted legislation to protect the basic human rights of their citizens. At present, our country is devoting to perfect the social security system continuously, and the housing security system has its important position. The low-rent housing security system is an important part of the housing security system in the face of the housing difficulties of the majority of low-income families. Since our country put forward the concept of low-rent housing system in 1998, the low-rent housing system has gone through more than 10 years of construction and development, although in this decade we have made certain achievements in the low-rent housing system. It solves the housing problem of some low-income housing groups in the whole country, but there are still many problems in practice and legal system. At present, the research on the low-rent housing system mainly involves the fields of sociology, administrative management, economics and so on. From the legal point of view, there is no legal provision for the construction of low-rent housing at this stage. There are only a few sectoral regulations that support the building and management of a low-rent housing system. Therefore, the low-rent housing security system has not formed a complete legal system and relevant supporting measures. In view of this, this paper analyzes the legal problems that may be encountered in the practice of low-rent housing construction, and on this basis classifies and integrates and formulates the Housing Security Law, which has profound theoretical and practical significance for the construction of the legal system of low-rent housing in our country. This paper is divided into five parts, the first part is the introduction part, which introduces the background and significance of the study of low-rent housing legal system, discusses the current research situation at home and abroad, and puts forward the writing methods and innovative points. The second part is an overview of the basic theory and legal basis of the low-rent housing system, the concept and analysis of the low-rent housing system, the characteristics of the low-rent housing system, the origin and development of the low-rent housing system. The legal basis of low-rent housing system and other basic issues are expounded. The third part is the comparison of the low-rent housing system in developed countries (or regions), which introduces the successful experiences of the United States, Singapore and Hong Kong in the construction and development of low-rent housing system. The fourth part deeply analyzes the problems of low-rent housing legal system in our country: low legislative level, narrow scope of protection objects, shortage of construction funds, limited supply of housing, insufficient supply of government land, access and exit mechanism of low-rent housing. Supervision and management, legal punishment mechanism is still imperfect and other related legal issues. The fifth part is the focal point of this paper, the author puts forward the concrete idea of constructing the legal system of low-rent housing in our country: to improve the legislative level of the legal system of low-rent housing, and to establish a multi-tiered security structure within the object of protection. To ensure the sources of funds and subsidies for the construction of low-rent housing, to regulate the rights and obligations of low-rent housing applicants and low-rent households, and to establish a scientific supporting mechanism for the legal system of low-rent housing, including the establishment of scientific standards of access to entities, Establish a perfect withdrawal link system, establish a hierarchical legal disciplinary system and so on.
