【摘要】：德國是現(xiàn)代社會保障制度起源地,而醫(yī)療保險又是德國社會保障制度建立之開端。究其歷史,德國醫(yī)療保險制度受到了社會、經(jīng)濟、政治與歷史文化等多因素的影響,是在勞工強烈反抗、勞資沖突尖銳的背景下,不同派別的政治精英與知識精英相互博弈的結(jié)果。其最突出的特點就是在建制之初確立了自治管理體制與機制,其內(nèi)部治理表現(xiàn)為勞資自治、專業(yè)自治與共同自治特色,外部治理則呈現(xiàn)出議會立法、行政監(jiān)督、司法裁判、自治管理機構(gòu)實施等的有序復(fù)合構(gòu)架,后來又表現(xiàn)出在國家干預(yù)和市場競爭下加以重塑的發(fā)展趨勢。其值得借鑒的經(jīng)驗是尊重本國國情,堅持責任均擔、勞資共治,堅持立法先行、依法實施。
[Abstract]:Germany is the origin of modern social security system, and medical insurance is the beginning of the establishment of German social security system. Looking at its history, the German medical insurance system was influenced by social, economic, political, historical and cultural factors. It was against the background of strong resistance by labor and sharp labor conflicts. The result of the game between the political elite and the intellectual elite of different factions. Its most prominent feature is the establishment of the autonomous management system and mechanism at the beginning of the establishment. Its internal governance is characterized by labor autonomy, professional autonomy and common autonomy, while external governance presents parliamentary legislation, administrative supervision, and judicial decisions. The implementation of autonomous management institutions and other orderly composite framework, and later showed a state intervention and market competition to reshape the development trend. Its experience is to respect the national conditions, uphold the responsibility, labor and management, adhere to legislation first, the implementation of the law.
