【摘要】：一直以來,關(guān)于公職人員犯罪的社會關(guān)注度很高,但我國針對因犯罪而喪失公職身份后的原公職人員養(yǎng)老保險權(quán)益方面研究則寥寥。目前,服刑完畢后的原公職人員養(yǎng)老保險權(quán)益缺乏肯定性規(guī)范,實踐中其在辦理養(yǎng)老保險接續(xù)時的難度也較高。本文梳理國家層面和具有代表性的地方層面關(guān)于服刑完畢后的原公職人員養(yǎng)老保險相關(guān)規(guī)定,結(jié)合案例呈現(xiàn)原公職人員養(yǎng)老保險權(quán)益存在的現(xiàn)實困境,發(fā)現(xiàn)其中存在的政策盲點和不合理因素,并從制度與思想觀念層面分析產(chǎn)生困境的原因。在此基礎(chǔ)上,重點以實現(xiàn)法的正義價值、維護(hù)刑法的基本原則、真正發(fā)揮養(yǎng)老保險的作用、完善我國社會保障體系、維護(hù)人權(quán)以及建設(shè)和諧社會為必要性考量;以國內(nèi)現(xiàn)有的研究成果、企業(yè)與事業(yè)單位養(yǎng)老保險改革經(jīng)驗以及部分國家公職人員養(yǎng)老保險制度為可行性考量,對原公職人員享有養(yǎng)老保險權(quán)益進(jìn)行學(xué)理分析。最后,建議抓住正在進(jìn)行的機(jī)關(guān)事業(yè)單位養(yǎng)老保險改革機(jī)遇,提出維護(hù)和完善原公職人員養(yǎng)老保險權(quán)益的構(gòu)想,以期促進(jìn)我國養(yǎng)老保險理論體系的完善。
[Abstract]:There has always been a high degree of social concern about the crime of public officials, but there are few studies in China on the pension insurance rights and interests of former public officials who have lost their official status as a result of crimes. At present, After serving the sentence, the pension insurance rights and interests of the former public officials are lack of affirmative norms. In practice, it is also more difficult to deal with the succession of pension insurance. This paper combs the relevant provisions of pension insurance for former public officials after the completion of the sentence at the national level and the representative local level. Combined with the case to present the real dilemma of the pension insurance rights and interests of the former public officials, found out the policy blind spot and unreasonable factors, and analyzed the reasons of the predicament from the system and the ideological level. On this basis, Focusing on the realization of the just value of the law, upholding the basic principles of criminal law, giving full play to the role of old-age insurance, perfecting our social security system, safeguarding human rights and building a harmonious society. Based on the experience of pension insurance reform in enterprises and institutions and the feasibility of pension insurance system for some national public officials, this paper makes a theoretical analysis of the pension insurance rights and interests of former public officials. It is suggested that we should seize the opportunity of the pension insurance reform in the government institutions and institutions and put forward the idea of maintaining and perfecting the pension insurance rights and interests of the former public servants in order to promote the perfection of the theoretical system of the endowment insurance in our country.
