【摘要】：由于我國城鄉(xiāng)二元體制的存在,農(nóng)村居民難以和城鎮(zhèn)居民一樣均等地享受到醫(yī)療、養(yǎng)老、失業(yè)醫(yī)療、養(yǎng)老、失業(yè)等社會保障待遇。作為典型的保障性物權(quán),農(nóng)村宅基地使用權(quán)承擔(dān)著社會保障的部分職能。由于農(nóng)村宅基地使用權(quán)制度的特點與人役權(quán)的特點具有較多的契合,所以農(nóng)村宅基地使用權(quán)制度改革應(yīng)以生存保障作為其基點。
[Abstract]:Because of the existence of urban-rural dual system, it is difficult for rural residents to enjoy medical treatment, old-age care, unemployed medical care, old-age pension, unemployment and other social security treatment on an equal footing with urban residents. The rural homestead use right bears part of the function of social security. Because the characteristics of the rural homestead use right system and the human servitude right have more agreement, the reform of the rural homestead use right system should take the survival security as its basic point.
