【摘要】：居住權(quán)制度起源于羅馬法,隸屬于羅馬法中的人役權(quán)制度。大陸法系國家在制定民法典時(shí),大都確立并規(guī)定了居住權(quán)制度；英美法系國家的判例中也有涉及居住權(quán)的條文。我國《物權(quán)法》草案中曾經(jīng)規(guī)定居住權(quán),但最終將其刪除。目前我國商品房的價(jià)格逐漸飆升,大多數(shù)城市居民無力購買,導(dǎo)致住房狀況十分緊張。然而由于我國未規(guī)定居住權(quán)制度,所以城市居民無法通過居住權(quán)來維護(hù)自己的居住權(quán)益。另外,我國的住房保障體系也不完善,加劇了城市居民住房情況的惡化。本文圍繞居住權(quán)制度展開論述,最后擬通過完善我國住房保障體系和建立居住權(quán)制度,共同構(gòu)成我國城市居民居住權(quán)社會保障制度來解決城市居民的居住問題。 本文內(nèi)容包括引言和四個(gè)章節(jié)。 本文引言主要介紹了我國當(dāng)今社會城市居民的居住現(xiàn)狀,并對產(chǎn)生這種的現(xiàn)狀的原因進(jìn)行了分析,從而引出本文后續(xù)的論述。 本文第一章對居住權(quán)制度進(jìn)行了概述。首先介紹了居住權(quán)的基礎(chǔ)理論即居住權(quán)的起源、概念及分類,其次對居住權(quán)的功能進(jìn)行了分析,最后分析了居住權(quán)的價(jià)值。 本文第二章對兩大法系國家規(guī)定的居住權(quán)制度進(jìn)行了比較研究。首先介紹了主要大陸法系國家對居住權(quán)制度的立法規(guī)定,其次介紹了主要英美法系國家涉及居住權(quán)的立法規(guī)定,最后分析了兩大法系國家對居住權(quán)制度的聯(lián)系和區(qū)別。 本文第三章闡述了我國創(chuàng)設(shè)城市居民居住權(quán)社會保障制度的必要性與可行性。首先分析了我國《物權(quán)法》未規(guī)定居住權(quán)制度的原因,然后具體闡述了我國設(shè)立城市居民居住權(quán)社會保障制度的必要性和可行性。 本文第四章提出了建立城市居民居住權(quán)社會保障制度的構(gòu)想。首先,對我國住房保障體系存在的問題予以分析并提出了相應(yīng)的完善對策；其次,論述我國應(yīng)設(shè)立居住權(quán)并說明了其立法目標(biāo)與立法體例；二者共同構(gòu)成城市居民居住權(quán)社會保障的主要內(nèi)容,最終達(dá)到解決城市居民居住問題的目的。
[Abstract]:The system of residence right originates from Roman law and belongs to the system of servitude in Roman law. There are also provisions concerning the right of residence in the jurisprudence of common law countries. The draft of China's Real right Law once provided for the right of abode, but it was eventually deleted. At present, the price of commercial housing in our country is soaring, and most urban residents cannot afford to buy it. The housing situation is very tense. However, because our country does not have a residence right system, urban residents cannot protect their housing rights and interests through the right of residence. In addition, the housing security system in our country is also not perfect. This paper focuses on the system of residence right, and finally proposes to perfect the housing security system and establish the system of residence right in our country. The social security system of urban residents' right of residence is formed to solve the residential problems of urban residents. This paper includes an introduction and four chapters. The introduction of this paper mainly introduces the current living conditions of the social urban residents in our country, and analyzes the causes of the present situation, which leads to the further discussion of this article. In the first chapter, the author introduces the basic theory of the right of residence, the origin, concept and classification of the right of residence, then analyzes the function of the right of residence, and finally analyzes the value of the right of residence. In the second chapter, the author makes a comparative study on the residence right system in the countries of the two major legal systems. Firstly, it introduces the legislative provisions of the residence right system in the major civil law countries. Secondly, it introduces the legislative provisions of the main Anglo-American law countries concerning the right of residence, and finally analyzes the relationship and difference between the two legal system. The third chapter expounds the necessity and feasibility of establishing the social security system of urban residents' right of residence in our country. Firstly, it analyzes the reasons why the system of residence right is not stipulated in the Real right Law of our country. Then the necessity and feasibility of setting up the social security system of urban residents' right of residence in China are expounded in detail. Chapter 4th of this paper puts forward the idea of establishing the social security system of urban residents' right of residence. Firstly, it analyzes the problems existing in the housing security system of our country and puts forward the corresponding perfect countermeasures. This paper discusses that the right of residence should be established in our country and explains its legislative goal and legislative style, which together constitute the main content of social security of urban residents' right of residence, and finally achieve the purpose of solving the problem of urban residents' residence.
