【摘要】：農(nóng)民工是伴隨我國制度變遷所產(chǎn)生的特殊現(xiàn)象,體現(xiàn)了我國經(jīng)濟(jì)體制轉(zhuǎn)型的過渡性特色。不可否認(rèn),農(nóng)民工為流入地創(chuàng)造了重要財富,已經(jīng)是我國社會進(jìn)步的巨大推動力,理應(yīng)得到理解和接納,但我國現(xiàn)有的歧視性制度和政策卻將他們排除在社會保障體系之外。農(nóng)民工付出一切奉獻(xiàn)給城市,卻只能無奈地留下傷疤。正是由于農(nóng)民工的巨大社會貢獻(xiàn)與他們的社會地位不相襯,損害了他們的合法利益,所以農(nóng)民工利益表達(dá)的愿望越來越強(qiáng)烈。農(nóng)民工利益表達(dá)的訴求能否得到滿足,不僅影響我國的經(jīng)濟(jì)發(fā)展和社會穩(wěn)定,而且關(guān)系著我國社會結(jié)構(gòu)能否轉(zhuǎn)型成功。因此,系統(tǒng)研究我國農(nóng)民工利益表達(dá)問題,對于構(gòu)建完善的農(nóng)民工權(quán)利保障制度具有特別重要的現(xiàn)實(shí)意義。本文在界定我國農(nóng)民工利益表達(dá)基本概念和闡述理論依據(jù)的基礎(chǔ)上,總結(jié)了當(dāng)前農(nóng)民工利益表達(dá)的現(xiàn)實(shí)情況。我國農(nóng)民工利益表達(dá)經(jīng)歷了“沉寂—萌芽—摸索”三個階段,正向制度化階段邁進(jìn)�；仡櫺侣劽襟w報道的關(guān)于農(nóng)民工利益表達(dá)的案例,對其達(dá)到的效果進(jìn)行認(rèn)真剖析,可以發(fā)現(xiàn)我國農(nóng)民工利益表達(dá)正在呈現(xiàn)新的變化趨勢。隨著我國教育的強(qiáng)力推進(jìn),農(nóng)民工的文化水平逐步提高,城市生活中長時間的耳濡目染、大眾媒介的廣泛傳播再加上農(nóng)民工自己的切身經(jīng)歷,使農(nóng)民工的維權(quán)意識不斷覺醒。現(xiàn)實(shí)生活中報道的“集體討薪”、“索求勞動賠償”等事件的成功,只是全國農(nóng)民工進(jìn)行利益表達(dá)的一個縮影。雖然有一些農(nóng)民工的利益訴求得到了滿足,但是絕大多數(shù)的農(nóng)民工還在為維護(hù)自己的合法利益進(jìn)行四處奔波。我國農(nóng)民工自身文化程度較低、組織化水平低,大部分人在利益受到侵犯時常常忍氣吞聲,無法通過組織的力量抵御侵害自己權(quán)益的行為;農(nóng)民工在人大代表中所占的比例很小,信訪制度存在缺陷使農(nóng)民工無法通過制度化的利益表達(dá)渠道表達(dá)利益訴求;城鄉(xiāng)二元戶籍分割制度及不健全的法律體系無法為農(nóng)民工利益表達(dá)提供制度化的保障;政府在觀念和政策上對農(nóng)民工存在著明顯的歧視;違背職業(yè)道德的大眾傳媒忽視農(nóng)民工的聲音,故意夸大農(nóng)民工的負(fù)面形象;企業(yè)缺乏社會責(zé)任感,為了追求高效益以犧牲農(nóng)民工的利益為代價。以上都是阻礙農(nóng)民工利益表達(dá)的因素。有效實(shí)現(xiàn)農(nóng)民工的利益表達(dá),只依靠某個人或單個團(tuán)體的力量還遠(yuǎn)遠(yuǎn)不夠,還需要農(nóng)民工、政府、社會組織、企業(yè)、大眾傳媒的共同參與和努力。我們不但要提高農(nóng)民工的利益表達(dá)能力,發(fā)揮大眾傳媒的積極作用,政府還要增強(qiáng)服務(wù)意識,積極發(fā)揮服務(wù)職能,保障農(nóng)民工利益表達(dá)的權(quán)利。在實(shí)現(xiàn)農(nóng)民工有效利益表達(dá)的路徑中,更要強(qiáng)化企業(yè)的社會責(zé)任感,農(nóng)民工利益受損的主要原因在于企業(yè)的失職,企業(yè)要與農(nóng)民工簽訂勞動合同,加強(qiáng)對農(nóng)民工的人文關(guān)懷。我們應(yīng)該凝心聚力,為農(nóng)民工利益表達(dá)的有效實(shí)現(xiàn)保駕護(hù)航,使農(nóng)民工利益表達(dá)逐步走向法制化、規(guī)范化的道路。
[Abstract]:Migrant workers is a special phenomenon with the changes of our country system generated, reflects the transitional characteristics of China's economic system transformation. It is undeniable that migrant workers for the inflow creates wealth, is the great driving force for social progress in our country, should be understood and accepted, but our existing discriminatory system and policy they will be excluded from the social security system of migrant workers pay. Dedication to the city, but only reluctantly left scars. It is precisely because the contrast of great social contributions of migrant workers and their social status, harm their legitimate interests, so to express the interests of migrant workers. A growing desire to express the interests of migrant workers demands can be met not only, the impact of China's economic development and social stability, and the relationship between the success of the transition of social structure in our country. Therefore, the research interests of our system of peasant workers The expression for the problem, is of great significance to construct the perfect system to protect the rights of migrant workers. Based on the definition of China's migrant workers interests expression basic concepts and describes the theoretical basis, summed up the current reality in China. The expression of the interests of migrant workers migrant workers expressed interest have experienced three stages: sprouting, quiet feeling, the stage of positive system forward. Review of the news media reported on the case of expression of the interests of migrant workers, the result of a careful analysis, we can find that the Chinese migrant workers interest expression is showing a new trend. With the advancement of education, migrant workers cultural level increases gradually, influenced by long time in the city life. Wide spread of mass media with their own personal experience to migrant workers, migrant workers rights consciousness awakening in real life. Reports of "collective pay talks", "labor demand compensation" of events such as success, just a microcosm of the national migrant workers interest expression. Although there are some migrant workers interests have been met, but the vast majority of migrant workers still maintain their legitimate interests are around. China's migrant workers with low education level the low level of organization, and most of the people in the interests are infringed often swallow, infringement of their rights act through the organization can not resist the power; for migrant workers in the National People's Congress in a small proportion of migrant workers cannot make the petition system defects through institutionalized interest expression channels to express their interest demands; two yuan in urban and rural areas segmentation of household registration system and not a sound legal system to the expression of interests of migrant workers provide institutional guarantee; government in the idea and policy of migrant workers in Clear discrimination against the occupation moral; mass media ignored the voice of migrant workers, migrant workers deliberately exaggerated the negative image of the enterprise; the lack of social responsibility, in order to pursue high efficiency at the expense of the interests of migrant workers cost. These are factors that hinder the expression of interests of migrant workers. The effective realization of the interests of migrant workers, only rely on a person or a single group the power is not enough, also need to migrant workers, the government, social organizations, enterprises, media participation and efforts. We should not only improve the interests of migrant workers skills, playing the positive role of the media, the government should strengthen the service consciousness, actively play the service function, to protect the interests of migrant workers in the path to achieve expression right. The effective expression of interest in migrant workers, but also to strengthen the sense of social responsibility of enterprises, the main reason of migrant workers in the interests of dereliction of duty, The enterprise must sign labor contracts with migrant workers, strengthen the humanistic care for migrant workers. We should implement effective ningxinjuli, escort for the expression of the interests of migrant workers, so that migrant workers benefit expression gradually legalized and standardized way.
