【摘要】：作為一種小額保險(xiǎn),農(nóng)村小額人身保險(xiǎn)具有雙重特征:一方面,它扮演著為低收入人群服務(wù)的角色;另一方面,它與國家社會(huì)保障制度體系建設(shè)相輔相成,并起著重要作用。目前,我國農(nóng)村小額人身保險(xiǎn)發(fā)展迅速,規(guī)模不斷壯大,并且越來越多的市場主體和個(gè)人參與進(jìn)來,但也出現(xiàn)一系列的問題。然而,我國目前并沒有專門的農(nóng)村小額人身保險(xiǎn)法律來對(duì)其進(jìn)行規(guī)制,這是一個(gè)重大缺陷。因此本文立足于我國實(shí)際情況,從法律角度提出問題和分析問題,并提出相關(guān)完善建議。本文的主要結(jié)構(gòu)如下:第一部分是農(nóng)村小額人身保險(xiǎn)法律制度的一般原理,主要闡釋農(nóng)村小額人身保險(xiǎn)的含義及其意義。第二部分是我國發(fā)展農(nóng)村小額人身保險(xiǎn)法律制度的必要性和可行性。第三部分主要分析我國農(nóng)村小額人身保險(xiǎn)法律制度的立法現(xiàn)狀及其存在的問題,主要闡述了我國缺少專門法律規(guī)范、完整的監(jiān)管制度、健全的農(nóng)村小額人身保險(xiǎn)配套性法律規(guī)定和高效的糾紛處理機(jī)制。第四部分是國外發(fā)展農(nóng)村小額人身保險(xiǎn)法律制度的經(jīng)驗(yàn)和評(píng)價(jià),分別介紹了印度、日本和菲律賓三個(gè)國家的法律制度。第五部分是完善農(nóng)村小額人身保險(xiǎn)法律制度,分別從建立專門法律制度、完善監(jiān)管制度、健全農(nóng)村小額人身保險(xiǎn)配套性法律規(guī)定和建立高效糾紛處理機(jī)制四個(gè)方面闡述如何完善。完成本文寫作的主要方法有對(duì)比、理論分析、實(shí)踐分析和跨學(xué)科分析等方法,對(duì)農(nóng)村小額人身保險(xiǎn)的一般原理和我國該項(xiàng)法律制度的現(xiàn)狀和存在問題進(jìn)行研究,在借鑒外國經(jīng)驗(yàn)的基礎(chǔ)上提出了完善建議,期待我國專門的農(nóng)村小額人身保險(xiǎn)法的盡早出臺(tái)。
[Abstract]:As a kind of micro-insurance, rural micro-life insurance has two characteristics: on the one hand, it plays the role of serving low-income people; on the other hand, it complements the construction of national social security system. And plays an important role. At present, the rural small personal insurance in our country is developing rapidly, the scale is growing, and more and more market main bodies and individuals participate in it, but there are also a series of problems. At present, there is no special rural small personal insurance law to regulate it, which is a major defect. Therefore, based on the actual situation of our country, this paper puts forward the problem and analyzes the problem from the legal point of view. The main structure of this paper is as follows: the first part is the general principles of the rural small personal insurance legal system. The second part is the necessity and feasibility of developing the legal system of rural small personal insurance. The third part mainly analyzes the rural small personal insurance law. The current legislative situation of the system and its existing problems, Mainly elaborated our country lacks the specialized legal norm, the complete supervision system, Sound rural small personal insurance supporting legal provisions and efficient dispute handling mechanism. Part 4th is the experience and evaluation of foreign countries in developing the rural small personal insurance legal system, respectively introducing India, The legal systems of three countries, Japan and the Philippines. 5th part is to perfect the legal system of rural micro-personal insurance, respectively from the establishment of a special legal system, to improve the supervision system. Perfecting the supporting laws and regulations of rural small personal insurance and establishing an efficient dispute handling mechanism. The main methods to complete the writing of this paper are as follows: contrast, theoretical analysis, practical analysis and interdisciplinary analysis, etc. This paper studies the general principle of rural small personal insurance and the present situation and existing problems of this legal system in our country, and puts forward some perfect suggestions on the basis of drawing lessons from foreign experience, and looks forward to the introduction of the special rural small personal insurance law as soon as possible.
