【摘要】：本文基于語言學(xué)、新聞學(xué)、法學(xué)等學(xué)科理論,主要從文體學(xué)和敘事學(xué)角度研究我國(guó)法制新聞話語的結(jié)構(gòu)形式與社會(huì)功能、語體特征與敘事規(guī)律,探究法制新聞話語建構(gòu)與解讀的內(nèi)在認(rèn)知機(jī)制,探索話語理論。法制新聞話語,包括制度新聞話語和案件新聞話語,前者主要報(bào)道法律制度立廢改等法制體系建設(shè)信息,后者主要報(bào)道權(quán)益糾紛之法律裁權(quán)等法治信息。法制新聞報(bào)道主要傳播法制信息和法治精神,對(duì)于法治社會(huì)建設(shè)具有重要作用。我國(guó)學(xué)界少有對(duì)法制新聞話語進(jìn)行研究,更少有結(jié)合文體學(xué)和敘事學(xué)研究方法研究法制新聞話語。筆者希望通過本研究彌補(bǔ)這一空白。 本研究創(chuàng)新之處主要表現(xiàn)在如下幾點(diǎn)。 1)本研究角度新穎。本文主要結(jié)合文體學(xué)、敘事學(xué)的理論與方法對(duì)報(bào)刊媒體和網(wǎng)絡(luò)媒體法制新聞話語的語體特征、話語結(jié)構(gòu)、敘事策略、敘事模式進(jìn)行研究,該研究有助于探索我國(guó)法制新聞話語的建構(gòu)與解讀規(guī)律。 2)本研究語料新穎。本文作者自行搜集整理并且創(chuàng)建了語料庫(kù),精心選擇了較有代表性的455篇法制新聞報(bào)道,語料的時(shí)間跨度為十年,即從2000年至2010年,語料來源于我國(guó)較有影響力的紙質(zhì)媒體和網(wǎng)絡(luò)媒體,有綜合性媒體,也有法制新聞專業(yè)媒體,語料內(nèi)容包括敘述法律制度體系建設(shè)信息的制度新聞報(bào)道,以及敘述法治實(shí)踐活動(dòng)信息的案件新聞報(bào)道。筆者對(duì)這些語料進(jìn)行分類整理、統(tǒng)計(jì)分析。本研究所得結(jié)論,均建立在對(duì)此語料進(jìn)行分析的基礎(chǔ)上。 3)本研究觀點(diǎn)新穎。本文提出了“隱含敘述者”這一概念,總結(jié)了我國(guó)法制新聞話語在紙質(zhì)媒體中的“中心文本+衛(wèi)星文本”等結(jié)構(gòu)形式以及在網(wǎng)絡(luò)媒體中的“超文本鏈接立體式報(bào)道”的結(jié)構(gòu)形式,并且擬構(gòu)了我國(guó)法制新聞話語的敘事模式。 本研究各章主要內(nèi)容概括如下。 第一章主要對(duì)本文研究對(duì)象進(jìn)行界定,法制新聞話語是新近發(fā)生或發(fā)現(xiàn)的法律事件的報(bào)道,主要表現(xiàn)為制度新聞和案件新聞。接著綜述了國(guó)內(nèi)外的相關(guān)研究,揭示了法制新聞話語是一個(gè)有待開墾的話語研究陣地。 第二章研究了法制新聞話語的標(biāo)題結(jié)構(gòu)形式及其語言特色。法制新聞標(biāo)題的主題構(gòu)成形式有五種,即,“地名+人名”式主題、“地名+類稱詞語”式主題、“身份/稱謂+(人名/類指)”式主題、“地點(diǎn)+稱謂+(人名)”式主題和“xx+案/事件/門”式主題。法制新聞雙標(biāo)題形式有三大類十小種,其中,三大類為,“句子+句子”式雙標(biāo)題、“一句話”式雙標(biāo)題、以及“短語+短語”式雙標(biāo)題。法制新聞雙標(biāo)題語義邏輯關(guān)系有六種,即,因果關(guān)系雙標(biāo)題、并列關(guān)系雙標(biāo)題、遞進(jìn)關(guān)系雙標(biāo)題、解釋關(guān)系雙標(biāo)題、總分關(guān)系雙標(biāo)題、特殊關(guān)系雙標(biāo)題。 第三章研究了法制新聞?wù)慕Y(jié)構(gòu)及其語言特色。法制新聞報(bào)道的文本結(jié)構(gòu)形式主要有:紙媒法制報(bào)道的兩種文本結(jié)構(gòu),即“標(biāo)題+導(dǎo)語+正文”單文本結(jié)構(gòu)以及“中心文本+衛(wèi)星文本”多文本結(jié)構(gòu);網(wǎng)絡(luò)法制報(bào)道的超鏈接立體式之文本結(jié)構(gòu)。法言法語是法制新聞話語的主要語言特色。法制新聞話語,以報(bào)道語體為主,其中報(bào)道中引用的法庭辯論是口頭書卷語體,法院判決書是事務(wù)語體,法律術(shù)語是科學(xué)語體用語。 第四章研究了法制新聞話語的敘事策略與敘事模式。法制新聞話語敘事策略主要表現(xiàn)在聲音、視角、時(shí)空等方面。法制新聞話語中存在“隱含敘述者”,即敘述者所代言的真正敘述者,是法制新聞報(bào)道的終端發(fā)話人。本文在Yakobson敘事模式、Labov敘事模式、Chatman敘事模式、Martin敘事模式等四大經(jīng)典敘事模式基礎(chǔ)上建構(gòu)了我國(guó)法制新聞報(bào)道的敘事模式。這對(duì)于法制新聞話語的建構(gòu)與解讀有一定的指導(dǎo)意義。 第五章研究了法制新聞話語的功能。法制新聞話語具有四大主要功能,即法制信息傳播功能、社會(huì)輿論導(dǎo)向功能、法治建設(shè)推進(jìn)功能、審美移情提升功能等。 第六章研究了法制新聞話語建構(gòu)與解讀。法制新聞話語建構(gòu)以標(biāo)題和正文的寫作為主。法制新聞話語交際雙方構(gòu)成復(fù)雜,主要有記者與讀者、隱含敘述者與敘述讀者等。對(duì)話性是法制新聞話語文本屬性。意識(shí)形態(tài)是法制新聞話語潛藏文本信息。 第七章回顧了本研究的主要觀點(diǎn),提出了本研究的局限之處,并且展望了后續(xù)研究。
[Abstract]:This paper, based on the theories of linguistics, journalism, law and so on, mainly studies the structure form and the social function, the structure and the narrative law of the legal news discourse in our country from the perspective of the stylistics and the narratology, and probes into the internal cognitive mechanism of the construction and interpretation of the news discourse of the legal system, To explore the theory of discourse. The former mainly reports the legal system construction information, such as the legal system of the legal system, and the latter mainly reports the rule of law information such as the legal discretion of the rights and interests. The rule of law information and the spirit of the rule of law are the main dissemination of the rule of law, which plays an important role in the social construction of the rule of law. There are few studies on the rule of law and news in the field of China, and it is more difficult to study the legal news discourse in combination with the study of stylistics and narratology. The author hopes to make up the gap through this study. This is the construction of the news discourse of the rule of law. In chapter five, the function of legal news discourse is studied in Chapter 5.
