【摘要】： 法治化是成熟的市場(chǎng)經(jīng)濟(jì)社會(huì)的本質(zhì)特征之一。政府采購(gòu)既是一種國(guó)家公權(quán)力,也是一種重要的政府行政行為。推行政府采購(gòu)制度是建立公共財(cái)政制度的必由之路,是宏觀調(diào)控經(jīng)濟(jì)的重要手段,也是從源頭上防治腐敗的治本措施。 伴隨著市場(chǎng)經(jīng)濟(jì)運(yùn)行機(jī)制的完善和行政管理體制改革的深化,政府采購(gòu)制度正逐步在全國(guó)各地推行,但還存在著一些突出問(wèn)題。筆者在從事反腐敗抓源頭工作中,參與對(duì)吉林省推行政府采購(gòu)制度工作情況的調(diào)查,組織起草了《吉林省省直政府采購(gòu)若干規(guī)定》,報(bào)省政府審定后,以“吉政發(fā)[2009]19號(hào)”文件下發(fā)。本文在對(duì)國(guó)內(nèi)外的政府采購(gòu)制度進(jìn)行比較的基礎(chǔ)上,針對(duì)調(diào)研過(guò)程中發(fā)現(xiàn)的政府采購(gòu)工作若干問(wèn)題,通過(guò)行政法的視角對(duì)這些問(wèn)題進(jìn)行研究和探索,解決當(dāng)前推行政府采購(gòu)制度面臨的一些問(wèn)題,嚴(yán)密政府采購(gòu)的行政程序,推動(dòng)政府采購(gòu)公開、公平、公正地規(guī)范運(yùn)行,進(jìn)一步推動(dòng)我國(guó)政府采購(gòu)步入法治化道路。
[Abstract]:Rule by law is one of the essential characteristics of a mature market economy society. Government procurement is not only a national public power, but also an important government administrative behavior. To carry out the government procurement system is the only way to establish the public finance system. It is an important means of macroeconomic regulation and control, and also a fundamental measure to prevent and cure corruption from the source. With the perfection of the market economy and the deepening of the reform of the administrative system, the government procurement system is being carried out step by step in all parts of the country, but there are still some outstanding problems. In the work of fighting corruption at the source, the author participated in the investigation of the implementation of the government procurement system in Jilin Province, and organized the drafting of the regulations on Government Procurement in Jilin Province, which were submitted to the provincial government for examination and approval. Issued under the document "Ji Chengfa [2009] 19". Based on the comparison of domestic and foreign government procurement systems, this paper studies and explores some problems in government procurement from the perspective of administrative law. To solve some problems that the government procurement system is facing at present, to tighten the administrative procedure of government procurement, to promote the public, fair and impartial operation of government procurement, and to further promote our government procurement into the road of rule by law.
