行政程序正當(dāng)性的證成——行政民主的啟示

【摘要】: 出于長(zhǎng)時(shí)間對(duì)行政程序理論及實(shí)踐的學(xué)習(xí)和思考,筆者選擇了行政程序正當(dāng)性證成的論題。自從80年代我國(guó)刮起一股“程序熱潮”開始,我國(guó)學(xué)者對(duì)此進(jìn)行了大量的研究探索,逐漸改變了“重實(shí)體、輕程序”的傳統(tǒng)法制觀念。對(duì)行政程序的逐漸重視也引發(fā)了對(duì)國(guó)外經(jīng)驗(yàn)的引進(jìn),這對(duì)于行政程序法制的建設(shè)無疑是重要的。然而,矯枉過正往往會(huì)弄巧成拙,我們?cè)谛问街髁x影響下依葫蘆畫瓢地制定各種程序規(guī)定,卻忽略了行政程序的“合法性”和“正當(dāng)性”命題之間的區(qū)別。法律程序本身是個(gè)中性的描述性概念,法律中規(guī)定的行政程序并不必然就是正當(dāng)程序,缺乏正當(dāng)性支持的程序運(yùn)行無法獲得公眾的認(rèn)可和接受。只有將一定的實(shí)質(zhì)精神融入其中,才能保證行政程序的正當(dāng)性基礎(chǔ)。在這個(gè)立論基礎(chǔ)上,全文共分以下幾部分進(jìn)行論述: 第一部分是對(duì)行政程序正當(dāng)性的相關(guān)概念進(jìn)行的界定。筆者通過在法哲學(xué)學(xué)層面上對(duì)正當(dāng)性(legitimacy)和合法性(legality)的辨析,說明行政程序的“正當(dāng)性”是對(duì)行政程序提出的高于“合法性”的要求,是指行政程序所具有的價(jià)值合理性和道德依據(jù),集中表現(xiàn)為行政程序?qū)θ藗冎黧w性的尊重與關(guān)懷以及人們對(duì)行政程序的認(rèn)可與信任。根據(jù)正當(dāng)性問題的普遍性,筆者說明了對(duì)行政程序正當(dāng)性證成的理論基礎(chǔ)和必要性。 第二部分是對(duì)行政程序正當(dāng)性證成方式的分析。筆者認(rèn)為,證成方式的選擇必須對(duì)兩個(gè)因素進(jìn)行考量:一是行政程序正當(dāng)性的要求,二是我國(guó)行政程序的正當(dāng)性危機(jī)。二者分別代表著理論上的論證要求和現(xiàn)實(shí)中的問題意識(shí)。通過對(duì)自然公正原則和正當(dāng)法律程序原則的分析,筆者認(rèn)為行政程序正當(dāng)性應(yīng)當(dāng)在實(shí)體目標(biāo)上體現(xiàn)為對(duì)權(quán)利、控權(quán)和效率的價(jià)值追求,在程序上表現(xiàn)為參與、中立、公開等程序要求。而我國(guó)目前的行政程序之所以缺乏公信力的原因就在于立法者和執(zhí)法者過于機(jī)械化地關(guān)注法律規(guī)定的表面意思,而忽略了行政程序最原初的正當(dāng)性精神內(nèi)核,背離了控權(quán)、權(quán)利和效率的價(jià)值追求以及對(duì)程序參與、中立和公開的形式要求。而傳統(tǒng)判斷模式——絕對(duì)工具主義模式、相對(duì)工具主義模式、經(jīng)濟(jì)效益主義模式、程序主義模式——有著各自的缺陷,筆者在分析行政民主的產(chǎn)生及含義的基礎(chǔ)上,認(rèn)為以公民參與和信息公開為核心的行政民主不僅能夠體現(xiàn)程序本身的價(jià)值,也能夠保證實(shí)體結(jié)果的公正,契合了行政程序的正當(dāng)性要求。 第三部分是對(duì)行政民主如何證成行政程序正當(dāng)性的分析。筆者認(rèn)為以行政民主為圓心,可以分別擴(kuò)展出權(quán)利、控權(quán)、效率以及參與、中立、公開要求,從而構(gòu)建了一個(gè)以行政民主為圓心的擴(kuò)展模式。行政民主是保證這些要求得以實(shí)現(xiàn)的精神內(nèi)核,將行政民主融合在行政程序的各個(gè)環(huán)節(jié),能夠保障程序的正當(dāng)性,從而實(shí)現(xiàn)程序正義和實(shí)體正義的統(tǒng)一。 第四部分是對(duì)如何將行政民主落實(shí)在行政程序具體制度中的探討。筆者認(rèn)為公民參與和信息公開作為行政民主的核心,表現(xiàn)在具體的聽證制度和信息公開制度中。以行政民主重構(gòu)行政程序首先要求聽證制度中均衡的各方利益代表、聽證過程的透明、專家理性和公民參與的平衡、多項(xiàng)選擇安排和兩讀程序、公民參與實(shí)質(zhì)上影響力的提高;其次要求信息公開制度中公開范圍和明確和電子政務(wù)的建設(shè)。
